such publications, interviews, news releases, and other communications of similar nature

<br />Health and Human Services or the North Carolina Department of Commerce." Three copies of
<br />each such publication, interview, news release or other communication shall be furnished to
<br />the Grantee.
<br />
<br />5. Col3yrights. If the Contract results in a book or other copyrightable material, the author Js
<br />free to copyright the work, but the HHS and the Grantee reserve a royalty-free, non-exclusive --
<br />and irrevocable license to reproduce, publish, or otherwise use, and to authorize others to use,
<br />all copyrighted material and all material which can be copyrighted resulting from the Contract.
<br />
<br />6. Patents. Any discovery or invention arising out of or developed in the course ~f work
<br />aided by this Contract shall be promptly and fully reported to the Grantee for determination as
<br />to whether patent protection on such invention or discovery·shall be sought and how the "
<br />rights in the invention or discovery, including rights under any patent issued thereon, shall be
<br />disposed of and administered, in orde¢ tO protect the public interest.
<br />
<br /> 7. Covenant Acjainst Contingent F.ees. The Contractor warrants that no person or selling
<br /> agency or other organization has been employed or retained to solicit or secure this Contract
<br /> upon an agreement or understanding for a commission, percentage, brokerage, or contingent
<br />· . fee. For.brea. ch or violation of..this warrant, the Grantee shall have the right to annul this
<br /> ........ Contract without liability or, in its discretion~ to deduct from,the'compensationi or. otherwise .......... ·
<br /> recover, the full amount of such commission.

<br />8. Discrimination i~ Employment Prohibited. The Contractor will not discriminate against any
<br />employee employed in the performance of this Contract, or against any applicant for
<br />employment in the performance of this Contract because of race, sex, age, creed, color,
<br />physical handicap or national origin. The Contractor will take affirmative action to ensure that
<br />applicants are employed, and that employees are treated during employment, without regard
<br />to race, sex, age, creed, color, physical handicap or national origin. This requirement shall
<br />apply to, but not be limited to, the following: employment, upgrading, demotion, or transfer;
<br />recruitment or recruitment advertising; layoff or termination; rates of pay or other forms of
<br />compensation; and selection for training, including apprenticeship. In the event that the
<br />Contractor signs any contract which would be covered by Executive Order 10925 (March 6,
<br />1961) or Executive Order 11114 (June 22, 1963), the Contractor shall include the
<br />equal-employment opportunity clause specified in section 301 of Executive Order 10925, as
<br />amended. The Contractor will comply with the regulations promulgated by 10 CFR 1040
<br />entitled "Non-discrimination in Federally Assisted Programs", which implements the following
<br />public laws: Title VI of the Civil Rights Act of 1964; Section 16 of the Federal Energy
<br />Administration Act of 1972; the Age Discrimination Act of 1975; and Section 504 of the
<br />Rehabilitation Act of 1973.

<br />9. Political Activity Prohibited. None of the funds, materials, property or services contributed
<br />by the Agency or the Contractor under this Contract shall be used in the Performance of this
<br />
