ICABARRUS COU~I

NOflT~ CARO&I#A

MEMORANDUM

For November Agenda

To:

Date:

l~e:

Board of Commissioners
Commissioners Elect Bob Carruth and Richard Suggs

November 7, 2000

Staff Response/Report
Osprey Lake Subdivision Complaints
October County Commission Meeting

At .the October Board meeting, two residents of the Osprey Lake Subdivision (Randy Wiggins,
Dev~ioper) filed complaints with the County Commission (Attachment A). Staff was directed to
investigate the complaints as provided and report back to the Board

Staff provided preliminary information at the October Board meeting (Attachment B) and began further
inquiry after the Board meeting. The following day, myself and Mike Downs met with Mr. 'Wiggins.
He provided information (Attachment C) detailing sales agreements and property deed
restrictions/covenants.

Generally, this mobile home subdivision is served by individnal wells and septic tanks installed by the
developer. The individual buyers purchase the land through a land contract making payments to the
developer's agency for a specified period at a specified rate. The buyer then purchases a mobile home
from a dealer and the dealer is responsible for placement of the unit on the individual lots.

The developer usually has no involvement of the actual mobile home except through a contract service if
provided. Site grading and follow-up is between the "buyer" and the firm providing the mobile home
(along with any subcontracts as applicable).
