December 1998 Administration of Justice Bulletin No. 98/0.t <br /> <br />adjudication may be proved by stipulation of the par- <br />ties. an original or copy of the court record of the adju- <br />dication, a copy of records maintained by the Division <br />of Criminal Information or by the Office of Juvenile <br />Justice. or any other method the court finds to be <br />reliable. <br /> <br /> Disposition Chart <br /> <br /> The following chart indicates which level or levels <br />of disposition are available in a particular case: <br /> <br /> Delinquency History Level <br />Offense Low Medium High <br />Violent Level 2 or 3 Level 3 Level 3 <br />Serious Level 1 or 2 Level 2 Level 2 or 3 <br />Minor Level I Level I or 2 Level 2 <br /> <br /> Exception to Chart Commitment of <br /> Chronic Minor Offender <br /> When a juvenile is adjudicated delinquent for a <br />minor offense, the court may impose a Level 3 dispo- <br />sition ffthe juvenile has been adjudicated for four or <br />more prior offenses. In determining prior offenses, <br />each successive offense is one that was committed <br />after adjudication-of the preceding offense. <br /> <br /> Multiple Offenses <br /> When a juvenile is adjudicated deLinquent for <br />more tluan one offense during a session of juvenile <br />court, the court must consolidate the offenses for dis- <br />position and impose a single disposition as specified <br />for the class of offense and delinquency history, level <br />of the most serious offense. <br /> <br /> Level 1, Community Dispositions <br /> At Level 1. the court' may order the .types of <br />evaluation and treatment described earlier and may <br />also do any of the following. <br /> <br /> 1. Require that the juvenile be supervised in the <br /> juvenile's own home, or place the juvenile in <br /> the custody of a parent, the county department <br /> of social services, or another appropriate per- <br /> son or agency. [This alternative is the same as <br /> former GS. 7A-647(2).] <br /> 2. Excuse the juvenile fi.om the compulsory <br /> school attendance law. [This alternative is the <br /> same as former GS. 7A-648(3).1 <br /> <br />3. Order the juvenile to cooperate with a com- <br /> mtmity-based program, an intensive substance <br /> abuse treatment program, or a residemial or <br /> nonresidential treatment program. Participa- <br /> tion in the programs may not exceed twelve <br /> months. [This alternative is a modification of <br /> former G.S. 7A-649(6).] <br />4. Require full or partial restitution, up to $500, <br /> payable within a twelve-month period. <br /> [Except for the mount limitation, this alter- <br /> native is the same as former G.S. 7A-649(2). I <br />5. Impose a fine. [This alternative is the same as <br /> former G.S. 7A-649(5).1 <br />6. Order the juvenile to perform up to i00 hours <br /> of supervised community service. [Except for <br /> specifying a maximum number of hours, this <br /> alternative is the same as former GS. 7A- <br /> 649(4).1 <br />7. Order the juvenile to participate in the victim- <br /> offender reconciliation program. <br />8. Place the juvenile on probation under the <br /> supervision of a court counselor. (Probation is <br /> described more fully below.) <br />9. Order that the juvenile not be licensed to <br /> operate a motor vehicle. [This alternative is <br /> the same as former G,S. 7A-649(9), with the <br /> added reqtm'ement that the clerk of oourt <br /> notify the Division of Motor Vehicles of the <br /> order. I <br />I0. Impose a curfew on the juvenile. <br /> 11. Order that the juvenile not associate with <br /> specified persons or be in specified places. <br /> (This provision existed previously as a condi- <br /> tion of probation, but not as a specific dispo- <br /> sitional aitemative.) <br />12. Impose confinement on an intermittent basis <br /> in an approved detention facility, for not more <br /> than five 24-hour periods. [This alternative is <br /> the same as former G.S. 7A-649(7), except <br /> that it does not require that the confinement <br /> be completed within a 90-day period.] <br />13. Order the juvenile to cooperate with place- <br /> ment in a wilderness program. <br /> <br /> Level 2, Intermediate Dispositions <br /> At Level 2, the court may order the types of <br />evaluation and treatment described earlier, may order <br />any disposition from Level I (numbers 1 through <br />above), and must order at least one of the following <br />intermediate dispositions: <br /> <br /> 1.
