143 <br /> <br />local option one-cent sales tax in Cabarrus County to assist with <br />school construction. <br /> <br /> Commissioner Privette compared the tax rate and school <br />construction costs for Cabarrus and Iredell counties. He questioned the <br />need for the additional sales tax, stating Cabarrus County is growing <br />in revenues at $10 million a year. <br /> <br /> In response, Mr. Gilliam stated "show them the money" and the <br />organization would "back off" from its support of a local option sales <br />tax for school construction. <br /> <br /> Chairman Barnhart again stated that school construction costs <br />would be discussed during the upcoming Retreat along with the impact of <br />residential growth on schools and comparison of tax rates in other <br />counties. The Board invited Mr. Gilliam to attend the Retreat. <br /> <br />Annual Report f~r the Nursinq Home and Adult Care Home Community <br />Advisory Con~nittees - Linda Miller, O~udsman <br /> <br /> Ms. Linda Miller, Long Term Care Ombudsman, presented the annual <br />reports for the Nursing Home and Adult Care Home Community Advisory <br />Committees. She introduced the following Committee members who were <br />present for the meeting: Nursing Home Community Advisory Committee - <br />Billie Wyatt and Margaret Stevenson; Adult Care Home Community Advisory <br />Committee - Vickey Page and Kay Greene. <br /> <br /> The Board expressed appreciation to committee members for their <br />service. Also, Chairman Barnhart encouraged anyone interested in <br />serving on the two committees to call the Co6nty Manager's Office. <br /> <br />Zonino Ordinance ~nendment - Petition 98-05(T) Relatinq to the <br />Establishment of a Rimertown Overlay Zone - Public Hearlnq - 6:30 P.M. <br /> <br /> Mr. Jonathan Marshall, Planning Services Director, presented the <br />proposed amendment to the cabarrus County zoning Ordinance establishing <br />the Rimertown Community Overlay Zone as requested by area residents. <br />He asked that the phrase ~in any three-year period" be added to the end <br />of the first paragraph of Section 4-41 "Development Standards." <br /> <br />Mr. Hartsell explained the process for incorporation. <br /> <br /> At 7:45 P.M., chairman Barnhart opened the public hearing for <br />Petition 98-05(T). The Notice of the Public Hearing was published in <br />THE INDEPENDENT TRIBUNE on February 5 and 12, 1999 and in THE C~L~RLOTTS <br />OBSERVER (Cabarrus Neighbors} on February 4 and 7, 1999. <br /> <br /> Mr. Terry Barbee of the Rimertown Community supported the <br />proposed overlay zone. He stated it had nothing to do with the <br />incorporation of Rimertown and was developed as a result of community <br />meetings and input from the public. He cited concerns about the impact <br />of uncontrolled development in the community. <br /> <br /> Mr. Steve Love of Rimertown spoke in support of the proposed <br />Rimertown Community Overlay Zone. He asked those present in support of <br />the proposal to stand. Approximately 15 to 20 persons stood in <br />support, and two persons indicated opposition to the proposal. <br /> <br /> There was no one else who wished to address the Board, and <br />Chairman Barnhart closed the public hearing at 7:50 P.M. <br /> <br /> A motion was made by Commissioner Casper and seconded by <br />Commissioner Privette to approve Petition 98-05(T) establishing the <br />Rimertown Overlay Zone as presented by staff. <br /> <br /> There was lengthy discussion regarding the provision concerning <br />adequate public facilities. <br /> <br /> UPON SUBSTITUTE MOTION by Commissioner Fennel, seconded by <br />Commissioner Carpenter with Commissioners Fennel, Carpenter and <br />Privette voting for and Commissioner Casper and Chairman Barnhart <br />voting against, the Board approved Petition 98-05(T) with the deletion <br />of Section 4-41.7 until discussion of the Adequate Public Facilities <br />Ordinance at =he Retreat.
