145 <br /> <br />Major developments must include an effort to retain mature <br />trees. Existing trees of 12 inch diameter at breast height <br />(dbh) or greater must be identified and shall not be removed <br />except when buildings, roads or required utilities are to be <br />constructed. <br />All new roads shall be constructed to NCDOT standards as <br />prescribed in the Cabarrus CQuntv subdivision RCqulatiQn$. <br />The Rimertown community shall not be responsible for the <br />maintenance of these roads. A homeowners association or the <br />property developer shall be responsible for maintaining the <br />roads to NCDOT standards until such time as they are accepted <br />for public maiatenance. <br /> <br />Section 4-42. Appeals and exceptions. <br />Where a person, or persons, proposing a major development feels they <br />are not able to meet the requirements of this overlay zone, they may <br />appeal to the County Planning and Zoning Commission acting as a Board of <br />Adjustment. The Notice of the Public Hearing was published in THE <br />INDEPENDENT TRIBLrNE on February 5 and 12, 1999 and in THE CHARLOTTE <br />OBSERVER (Cabarrus Neighbors) on February 4 and 7, 1999.
