4.7 Captions. The captions or headings used throughout this Agreement are for convenience <br />only and in no way define, limit, or describe the scope or intent of any provision of this <br />Agreement. <br /> <br />4.8 Confidentiality. ROUSH, the City and the County acknowledge that Exhibits to this <br />Agreement. and/or other information provided by ROUSH pursuant to this Agreement, may <br />contain ROUSH trade secrets and/or confidential information. Accordingly, such information, if <br />so identified by ROUSH will be maintained in confidence by the County and City, unless its <br />re[ease is consented to in writing by ROUSH. <br /> <br />4.9 Construction. The parties acknowledge and stipulate that this Agreement is the product <br />of mutual negoti.ation and bargaining and that it has been drafted by counsel for the parties.
