140 <br /> <br />DRAFT <br /> <br />County shall include but not be limited to, fencing and lighting. Upon <br />expiration or other termination of the Lease, the Children's Home may <br />elect to keep any permanent building structures on the Property, such <br />as restroom or concession stand building structures, but must accept <br />these structures in "as is" condition. <br /> 1.2 Park Development. It is the intention and agreement of the <br />parties that the Property shall become part of the County park system <br />during the term of the Lease. Upon execution of the Lease, the County <br />shall develop a public park (the "Park") on the Property, the nature <br />and quality of which are more definitively described below. <br /> 1.3 Additional Park Property. The County may make good faith <br />efforts to seek out and acquire additional property adjoining the Park, <br />by purchase, lease or otherwise, which property, upon acquisition, <br />shall become part of the Park. <br /> <br /> Article II. Conditions of Lease Agreement <br /> 2.0 Gradinq. The County shall provide rough grading services in <br />the general development of recreational facilities at the Children's <br />Home in the Cottage Area, a project map of which property is attached <br />hereto as Exhibit "B". <br /> 2.1 Design. The County shall provide professional assistance in <br />the design of the recreational facilities at the Children's Home. <br /> 2.2 EmploYment Opportunities. The County shall provide <br />opportunities for residents of the Children's Home (ages 16 and older) <br />to apply for any available part time or full time positions of <br />employment at the Park for which the residents may be appropriate and <br />such applicants will be given serious consideration for employment. <br /> 2.3 Use of Facilities. It is understood that Children's Home <br />residents shall be permitted reasonable use Of the Park during qeneral <br />Park operational times, without charge. (However, any proposed use by <br />the Children's Home which may require extraordinary direct expenses to <br />the County will be discussed with the County prior to such use.) <br /> 2.4 Clean Up. The County shall agree to assist the Children's <br />Home in the clean up and removal of debris, old or abandoned <br />structures, ponds, etc. located at the back of the Children's Home Farm <br />Operations Center, south of the Duke Power easement and highlighted in <br />yellow on attached Exhibit 'A~. <br /> 2.5 Approval. The Children's Home will be given the opportunity <br />to participate in the review and development schedule and approval of <br />facilities to be located on their land. <br /> 2.6 Access to Wa~r. The County shall agree to provide necessary <br />mechanical access to water for the Children's Home to use for its <br />animals' drinking water. This means the County will provide, free of <br />charge, all necessary trenching and pipe configurations to carry water <br />to the specified location in the Farm Operations Center which is <br />highlighted in yellow on the attached Exhibi~ "A". Cabarrus County will <br />not be responsible for the purchase of water. <br /> <br /> Article III. Park Development <br /> 3.0 Park Development. The County will be authorized to make <br />certain improvements to the Property as necessary for development and <br />construction of a public park. These improvements may include <br />alterations in grading and other topographical modifications, turfing, <br />irrigation, etc. The County shall develop the Property for use as a <br />public park which shall include active and passive facilities commonly <br />found in the County public park system, and may include some or all of <br />the following facilities and activity areas: baseball/basketball areas, <br />softball/soccer fields with fencing and lighting, restroom facilities, <br />amphitheater, concession facilities, picnic shelters, volleyball <br />courts, horseshoe pits, playground, walking/jogging trail systems and <br />parking facilities and other improvements incidental to the use of a <br />public recreational facility. Efforts to establish a Park design <br />concept plan and development schedule will be commenced within three <br />(3) months following execution of this agreement. Allowing for <br />community input and interaction among governmental agencies inclusive <br />of permitting requirements, it is expected that the concept plan and <br />development schedule can be completed within twelve (12) months <br />following the execution of this agreement and the Lease. As a part of <br />the Park development, the County shall construct vehicular access from <br />Orphanage Road into the Park. Other access locations may be pursued as <br />further determinations may require. <br /> 3.1 Review of Development. The County shall complete a concept <br />plan for the development of the Park. During the Park design and <br />development process, County, City and Children's Home representatives <br />shall meet to review and evaluate design and development proposals <br />prior to incorporating such proposals into the final plans, it being <br /> <br /> <br />
