163 <br /> <br />Resolution No. 1999-06 <br /> <br />RESOLUTION OF THE CABARRUS COUNTY BOARD OF COMMISSIONERS <br />FOR STATE GRANT APPLICATION BY CABARRUS COUNTY <br /> <br />WHEREAS The Federal Clean Water Act Amendments of 1987, Federal Safe <br /> Drinking Water Act Amendments of 1996, and the North Carolina <br /> Clean Water Revolving Loan and Grant Act of 1987 have authorized <br /> the making of loans and grants to aid eligible units of <br /> government in financing the cost of construction of wastewater <br /> treatment works, wastewater collection systems, and water supply <br /> systems; and <br />WHEREAS Cabarrus County (County), the Town of Mt. Pleasant, and the Water <br /> and Sewer Authority of Cabarrus County (WSACC) has need for and <br /> intends to construct a wastewater collection system project <br /> involving the addition of approximately 34,000 linear feet of <br /> 8-inch to 30-inch gravity sewer to serve the Adams Creek basin, <br /> including Mt. Pleasant High School; and <br />WHEREAS The County intends to request State grant and loan assistance for <br /> the project. <br />NOW THEREFORE BE IT RESOLVED, BY THE CABARRUS COUNTY BOARD OF COMMISSIONERS <br />THAT: <br /> The County will seek reimbursement for all remaining costs of the <br /> project from WSACC, if approved for a State grant and loan award. <br /> <br />The County will turn the completed system over to WSACC for <br />operation, maintenance, and administration of the system. <br /> <br />The Commissioners of the County agree to include in the loan <br />agreement a provision authorizing the State Treasurer, upon <br />failure of the County to make scheduled repayment of the loan, to <br />withhold from the County any State funds that would otherwise be <br />distributed to the local government unit in an amount sufficient <br />to pay all sums then due and payable to the State as a repayment <br />of the loan. <br /> <br /> Frank Clifton, County Manager, of the County, and successors so <br /> titled, is hereby authorized to execute and file an application on <br /> behalf of the County with the State of North Carolina for a grant <br /> or loan to aid in the construction of the project described above. <br /> <br /> Frank Clifton, County Manager, of the County, and successors so <br /> titled, is hereby authorized and directed to furnish such <br /> information as the appropriate State agency may request in <br /> connection with such application or the project: to make the <br /> assurances as contained above; and to execute such other documents <br /> as may be required in connection with the application. <br /> <br /> The County has substantially complied or will substantially comply <br /> with all Federal and State grants and loans pertaining thereto. <br /> <br />Adopted this 15=h day of March, 1999. <br /> /s/ Jeffrey Barnhart <br /> Jeffrey Barnhart, Chairman <br /> <br />Attest: <br />/s/ Frankie F.
