11. UNAUTHORIZED USE OF SYSTEM LESSOR disclaims any express or implied warranty that its equipment is technically immune from or prevents fraudulent intrusions into and/or unauthorized use of the system (including its interconnection to a long distance network). LESSEE is hereby warned that fraudulent use of the system, including but not limited to DISA, Automated Attendant, Voice Mail, RMATS, 800 and 900 service, is possible. LESSEE hereby assumes all risk of such fraudulent or unauthorized use or intrusion. LESSEE hereby disclaims any express or implied warranty that its equipment is technically immune from or prevents unlawful and/or unauthorized utilization that may result in an invasion of one's fight to privacy. LESSOR hereby warns LESSEE that such is possible. ' 12. MUSIC ON HOLD LESSEE shall have full responsibility for all negotiations and licensing fees for performance rights relating to recorded or broadcast music usage or its access by the telephone system. 13. INDEMNITY LESSEE shall indemnify LESSOR against, and hold LESSOR harmless from, any and all claims for damages, costs, expenses and liabilities whether to persons or to property, arising out of the use or operation or resulting from said equipment. LESSEE shall carry adequate insurance in an amount satisfactory to LESSOR for the protection of the LESSEE and LESSOR in this respect. 14. DEFAULT If LESSEE, with regard to any item or items of equipment, fails to pay rent or other amount herein provided within ten (10) days after the same is due and payable, or if LESSEE with regard to any item or items of equipment fails to observe, keep or perform any other provision of this Lease required to be observed, kept or performed by LESSEE, LESSOR shall have the fight to exercise any one or more of the following remedies: A. To declare the entire amount of rent hereunder immediately due and payable as to any or all items of equipment, without notice or demand to LESSEE. B. To sue for and recover all rents, and other payments, then accrued or thereafter accruing, with respect to any or all items of equipment. To take possession of and remove any or all items of equipment, without any court order or other process of law, LESSEE hereby waives any and all damages occasioned by such taking of possession. Any said taking of possession shall not constitute a termination of this Lease as to any or all items of equipment unless LESSOR expressly so notifies LESSEE in writing.
