Memo <br /> <br />To: <br /> <br />From: <br /> <br />CC: <br /> <br />Date: <br /> <br />Re: <br /> <br />Board of Commissioners <br /> <br />Jonathan Marshall, Planning Services Director <br /> <br />Frank Clifton, County Manager <br /> <br />Fletcher Hart.sell, County Attorney <br /> <br />05/10/99 <br /> <br />Highway 49 C & D Landfill <br /> <br />Griffin Brothers Companies have proposed to construct and operate a construction and demolition <br />landfill (C & D landfill) in the Speedrail Industrial Park off Pharr Mill Road in Township 1. This C & D <br />landfill has already received the conditional use permit required by the Cabarrus County Zoninp <br />Ordinance. The State requires that a franchise agreement also be approved based on the County's <br />Solid Waste Manaqement Ordinance (Chapter 58). <br /> <br />The franchise requirement of the Solid Waste Management Ordinance has been employed in the past <br />only in cases of exclusive franchises for municipal solid waste collection. The requirement for a non- <br />exclusive franchise for a C & D Landfill is the result of a recent interpretation by the NC Attorney <br />Generals Office that Counties with local solid waste ordinances must pen"orm this review. <br /> <br />The attached Franchise Agreement is modeled on the existing exclusive franchise agreement with BFI <br />for municipal solid waste collection. The Solid Waste Management Ordinance is intended to review the <br />proposal for operation, market area and liability. The land use review has already been done as part of <br />the conditional use process, <br /> <br />The Board of Commissioners review should include a report by staff, presentation by the <br />owner/operator and public comment. <br /> <br />If there are any questions concerning this matter, please do not hesitate to contact me, <br /> <br />· Page 1 <br /> <br /> <br />
