Section 9: This agreement is subject to and incorporates the attached Parts II and III, as if written word for word herein. Section 10: The Subcontractor agrees to assist the Subgrantee in complying with all of the Conditions Governing Grants under the National Energy Conservation Policy Act. Section ~11: The continued performance of this contract by the Subgrantee is dependent upon the availability of funds for this purpose and the Subcontractors ability to carry out the purpose of the Weatherization Assistance Program as prescribed in the North Carolina WAP State Plan (including all program guidance, manuals, laws, rules and regulations), as well as, consistent with Part II Section I of this agreement. Should funds for this purpose cease to be available, this contract shall automatically terminate. Section 12: Honesty and Fidelity Bonds. The Subcontractor shall maintain throughout the duration of this Contract a Honesty and Fidelity bond that protects the program against theft, damages, or other abuses that may occur while this contract is in force. Such Honesty and Fidelity bonds should be at least 15% of the total funds awarded under this Contract. The Subgrantee recommends that the Subcontractor also maintain liability insurance to protect against personal injury and property damage sustained during weatherizaiton activities. Section 13: Residential Enerqy Conservation Assistance Proqrams Manager (RECAP) is designated as "Contract Administrator'' with the responsibilities of monitoring the activities of the Subcontractor with respect to its implementation of the program in accordance with the provisions outlined in parts I, II and III, and in certifying that work has been performed before invoices are paid. Section 14: The Subcontractor certifies that neither the organization nor any of its principals is presently debarred, suspended, proposed for debarment, declared ineligible, or voluntarily excluded from participating in this Agreement by any Federal department or agency. Section 15: The Subcontractor certifies that it will comply with prohibitions and requirements for disclosure and certification related to lobbying on recipients of Federal contracts, grants, cooperative agreements, and loans as contained in the Federal Register 10CFR 601. Section 16: Agreements in Excess of $100,000. -All applicable standards, orders, or requirements issued under Section 306 of the Clear Air Act (42 U.S.C. 1857(h), Section 508 of the Clean Water Act (33 U.S.C. 1368), Executive Order 11738, and Environmental Protection Agency regulations (40 CFR Part 15) must be adhered to.
