~ORTX CAROLllA

July 29, 1999

To:

Cabarrus County Board of Commissioners
Cabarrus County Manager
Cabarrus County Deputy Manager

From:

Mr. Steve Little, Director
Cabarrus County Parks and Recreation Department

Subject:

Proposed Lease Agreement of 39.60 acres for Soccer Complex from the State of
North Carolina to Cabarrus County

On June 7, 1999, the State of North Carolina Council of State approved a twenty-five year lease
agreement with Cabarrus County for the purpose of constructing eight regulation soccer fields on
39.60 acres. If approved by the Cabarrus County Board of Commissioners, the lease agreement
and memorandum of lease will be submitted to the Governor of North Carolina for the necessary
signatures. After execution, the State will return an original agreement to Cabarrus County. The
State officials requested that Cabarrus County not date the lease agreements, thus allowing the
governor's office to date them.

One of the State's concerns was that the proposed soccer fields would be adjacent to a fifteen
hundred foot Public Television tower. This proposed lease agreement has several items that
address their concerns. The State will require Cabarrus County to construct a six (6) foot high
fence and to close and remove park patrons from the soccer fields if weather conditions such as
freezing weather or lighting storms occur, or if general maintenance is performed on the tower.

The proposed lease agreement has the following general guidelines (1) 25 year lease with an
option to extend the term of the lease; (2) 39.60 acres (refer to attached map); (3) $1.00 term
rental; (4) term temdnation clause that allows the State to reclaim the property for a major
industrial or economical improvement project with a 180 day written notice; (5) fees waived for
Stonewall Jackson School students (athletic purposes); (6) State's permission for the County to
relocate farm roads and property fencing on proposed lease tract; and (7) State's permission to
allow Cabarrus County to construct soccer fields with grading, turfing, irrigation and lights on
the site.

Parks and Recreation Department

5~ 7h .-:,-: ......, 7: . ~2:~cx7O7 · S^r'c~'~ ~"~
....... 7'i '/~ .,J 2¢725 77:37
