If approved by the Cabarrus County Board of Commissioners, the lease agreement <br />and memorandum of lease will be submitted to the Governor of North Carolina for the necessary <br />signatures. After execution, the State will return an original agreement to Cabarrus County. The <br />State officials requested that Cabarrus County not date the lease agreements, thus allowing the <br />governor's office to date them. <br /> <br />One of the State's concerns was that the proposed soccer fields would be adjacent to a fifteen <br />hundred foot Public Television tower. This proposed lease agreement has several items that <br />address their concerns. The State will require Cabarrus County to construct a six (6) foot high <br />fence and to close and remove park patrons from the soccer fields if weather conditions such as <br />freezing weather or lighting storms occur, or if general maintenance is performed on the tower. <br /> <br />The proposed lease agreement has the following general guidelines (1) 25 year lease with an <br />option to extend the term of the lease; (2) 39.60 acres (refer to attached map); (3) $1.00 term <br />rental; (4) term temdnation clause that allows the State to reclaim the property for a major <br />industrial or economical improvement project with a 180 day written notice; (5) fees waived for <br />Stonewall Jackson School students (athletic purposes); (6) State's permission for the County to <br />relocate farm roads and property fencing on proposed lease tract; and (7) State's permission to <br />allow Cabarrus County to construct soccer fields with grading, turfing, irrigation and lights on <br />the site. <br /> <br /> Parks and Recreation Department <br /> <br />5~ 7h .-:,-: ......, 7: . ~2:~cx7O7 · S^r'c~'~ ~"~ <br /> ....... 7'i '/~ .,J 2¢725 77:37 <br /> <br /> <br />
