<br /> any party for purposes o[ insuring safety and security on School
<br /> Facilities.
<br /> (i) Food Service/Refrigeration - This service shall include but not
<br /> be limited to, boilers, ~oolers, ranges, refrigerators, walk-in
<br /> coolers, cookers, ovens of any sort (including convection and
<br /> microwave), garbage disposal and compaction, fryers, rotisseries,
<br /> broilers, slicers, batter mixers, all kitchen appliances of
<br /> whatever kind or nature, including warmers, chillers, braising
<br /> pans, stoves, ice machines. The Child Nutrition Department of
<br /> the County and the City of Kannapolis shall be invoiced
<br /> separately for all parts (but not labor), repaired or replaced by
<br /> the Department pertainin9 to this specific category.
<br /> All of the above maintenance and repair services shall hereafter be
<br />collectively referred to as the "Services."
<br /> 5. Department Employment/Director Of Services -The Department shall
<br />be under the control and supervision of the Director of the Department (the
<br />~Director"). The Director will report directly to the Superintendent of the
<br />Cabarrus Board (~Cabarrus Superintendent") until such time when (and if) the
<br />County consolidates its maintenance and repair services into the Department.
<br />If County consolidation occurs, the Boards and the County will reevaluate the
<br />reporting requirements of the Director at that time. The Director will
<br />provide written reports to the Cabarrus Superintendent at least once per
<br />quarter. In the event the Director resigns, retires or is terminated, the
<br />Superintendents of the Boards will nominate and appoint a new Director who is
<br />mutually satisfactory to the County and the Boards. The Cabarrus Board will
<br />provide the Director with an'enumeration of his responsibilities, including
<br />without limitation, monitoring all Services set forth above as well as
<br />Services provided under any contract with third parties.
<br /> 6. Annual Maintenance and Repair Plan - Upon execution of this
<br />Agreement, the Director will be charged with the responsibility of promptly
<br />conducting a survey of the School Facilities and shall use this survey in
<br />preparing an annual Maintenance and Repair Plan (the "Plan") which covers the
<br />School Facilities and all responsibilities set forth herein, as well as the
<br />status of completing those responsibilities as of the date of the Plan. The
<br />Plan will contain the proposed Services schedule and budget for the upcoming
<br />fiscal year and shall prioritize all School Facilities repair projects. The
<br />Director will present the Plan to the Superintendents for the Boards (the
<br />"Superintendents") by March 1, 2000, and by March 1~t of each year thereafter
<br />during the term of this Agreement. The Plan must receive approval by the
<br />Superintendents. The approved Plan will then be presented as a component of
<br />the school budget request to the County Manager and the County Board of
<br />Commissioners no later than April 15, 2000; and no later than April 15 of
<br />each year thereafter.
<br /> 7. Funding - Implementation of this Agreement is contingent upon the
<br />County Board of Commissioners allocating to each Board respectively, for each
<br />fiscal year this Agreement is in effect, a minimum of $1,006.00 per pupil in
<br />each Board's school system, based upon the per pupil ADH Numbers allocated to
<br />each Board. During each year this Agreement is in effect, the Boards will
<br />each contribute to the Department funds for the Services as more fully set
<br />forth herein (the "Fund"). (However, in the event the County merges its
<br />maintenance and repair staff into the Department, the County and the Boards
<br />will, at that time, reevaluate the basis for allocation of contributions
<br />among the Parties.) The Fund will be used exclusively by the Department to
<br />provide the Services, including Department payroll. The Fund will receive
<br />(subject to certain conditions more fully set forth below), each fiscal year,
<br />allocations from each Board based upon a per pupil amount agreed upon by the
<br />Parties multiplied by the number of pupils in each Board's school system. For
<br />purposes Of determining the number of pupils in each Board's school system,
<br />the Parties agree that the state certified projected attendance numbers
<br />issued each year in March will be used (the "ADM Number(s)"). Therefore, each
<br />fiscal year, each Board shall pay to the Fund that amount equal to the per
<br />pupil amount agreed to by the Boards each fiscal year, multiplied by the ADH
<br />Number of pupils in their respective school systems. Kannapolis' payment
<br />contribution to the Fund shall include the same per pupil amount for each
<br />pupil who resides in Rowan County.
<br /> The Fund allocations from each Board of Education will be divided into
<br />the below categories:
<br /> (a) Grounds and Maintenance Services. For each fiscal year of this
<br /> Agreement, the amount allocated to the Fund for grounds and
<br /> maintenance Service shall be a minimum of $817~432 Based upon
<br /> the North Carolina ADM Numbers of 18,522 (85.74%) students in the
<br /> County Schools and 3,080 (14.26%) students in Kannapolis city
<br /> Schools that reside in Cabarrus County for the 1999-2000 school
<br /> year, the Cabarrus Board shall allocate a minimum of $700,866.20
<br /> and the Kannapolis Board shall allocate a minimum of
