STATE OF NORTH CAROLINA SERVICE AGREEMENT COUNTY OF CABARRUS THIS AMENDED AGREEMENT, made and entered into this day of , 1999 by and between Cabarrus County, North Carolina, a corporate and political subdivision of the State of North Carolina ("County"), and H & R Lawn Service, Inc., 8800 Valley Street, Mount Pleasant, North Carolina 28124 ("Contractor"). WITNESSETH: WHEREAS, the Board of Commissioners of the County has awarded the bid for the turf improvements for parks, grounds, and schools as such services and maintenance are'described in the County's Specifications and Invitation for Bids which is attached hereto as Schedule ,q and incorporated by reference as if fully set forth herein (the "Specifications"). The bid is awarded pursuant to North Carolina General Statutes. NOW, THEREFORE, for and in consideration of the mutual covenants and promises expressed herein, the parties hereto agree as follows: ITEM 1. Contractor's Obligations. (a) That the Contractor will provide the County with the lawn and grounds maintenance set out in the Specifications, and in accordance with the Bid Proposal dated October 2, 1998, which is attached hereto as Schedule B and incorporated herein by reference (hereafter the "Services"). Co) The Contractor will furnish all necessary equipment and manpower required to fully perform the Services in a high quality and timely fashion, at the price specified herein. The equipment shall be suited for the job performed, shall be maintained properly and will be operated at all times in a safe manner, in compliance with manufacturer's specifications. The Contractor agrees to furnish all insurance (as required by the Specifications), all materials, supervision, permits, and abide by all local, state and federal laws, rules, regulations and codes
