STATE OF NORTH CAROLINA <br /> <br />COUNTY OF CABARRUS <br /> <br /> THIS AMENDED AGREEMENT, <br /> <br />SERVICE AGREEMENT <br /> <br />made and entered into this day of <br /> <br /> , 1999 by and between Cabarms County, North Carolina, a corporate and <br />political subdivision of the State of North Carolina ("County"), and Acme Turf Control Co., Inc. <br />154 Cabarrus Avenue, East, Post Office Box 1147, Concord, North Carolina 28026 <br />C'Contractor'). <br /> <br /> WITNESSETH: <br /> <br /> WHEREAS, the Board of Commissioners of the County has awarded the bid for the turf <br />improvements for parks, grounds, and schools as such services and maintenance are described in <br />the County's Specifications and Invitation for Bids which is attached hereto as Schedule ,4 and <br />incorporated by reference as if fully set forth herein (the "Specifications"). The bid is awarded <br />pursuant to North Carolina General Statutes. <br /> <br /> NOW, TI-IEREFORE, for and in consideration of the mutual covenants and promises <br />expressed herein, the parties hereto agree as follows: <br /> <br />ITEM 1. <br /> <br />Contractor's Obligations. <br /> <br />(a) That the Contractor will provide the County with the lawn and <br /> <br /> grounds maintenance set out in the Specifications, and in <br /> accordance with the Bid Proposal dated October 2, 1998, which is <br /> attached hereto as Schedule B and incorporated herein by reference <br /> (hereafter the "Services"). <br /> <br />(b) The Contractor will furnish all necessary equipment and manpower <br /> required to fully perform the Services in a high quality and timely <br /> fashion, at the price specified herein. The equipment shall be <br /> suited for the job performed, shall be maintained properly and will <br /> be operated at all times in a safe manner, in compliance with <br /> manufacturer's specifications. <br /> <br />(c) The Contractor agrees to furnish all insurance (as required by the <br /> Specifications), ali materials, supervision, permits, and abide by all <br /> local, state and federal laws, rules, regulations and codes <br /> <br /> <br />
