Ordinance No. 1999- <br /> <br /> AMENDMENT TO <br /> CABARRUS COUNTY CODE OF ORDINANCES <br /> CHAPTER 46 <br />OFFENSES AND MISCELLANEOUS PROVISIONS <br /> <br />BE IT ORDAINED that Section 46-2, Use of Firearms, of the Code of Ordinances, Cabarrus <br />County, North Carolina is hereby amended to read as follows: <br /> <br />Sec. 46-2. Discharge of firearms. <br /> <br /> (a) It shall be unlawful for any person in the County to discharge any firearm or air <br /> compression gun of any kind, nature, make, or description within a distance of <br /> 500 yards of any structure occupied for industrial, business or residential purposes <br /> by any person except as follows. <br /> <br />Where the occupied structure belongs to the person discharging the firearm or <br />guest(s) of the property owner who have been given written permission from <br />the property owner to discharge firearms on his/her property, and the <br />discharge is over 500 yards from structure(s) occupied by person(s) other <br />than the owner of the property when said person(s) have not granted in <br />writing permission to discharge a firearm within 500 yards of their occupied <br />structure; <br /> <br />By command ora military or law enforcement officer in the performance of <br />official duty or in the proper position for firing ceremonial salutes; <br /> <br />At or in a shooting range or gallery operated by a law enforcement agency; <br /> <br />In an area zoned by the Board of County Commissioners to permit such <br />discharge; <br /> <br />By securing a permit from the Sheriff'granting exemption from this <br />ordinance for special occasions. <br />Special occasions may include: <br />a. Turkey Shoot sponsored by non-profit organizations where no <br /> intoxicated individuals or alcoholic beverages are allowed and which are <br /> operated safely and do not unduly interfere with the reasonable peace and <br /> repose of persons living in close proximity to the event. <br />b. Firearms safety classes sponsored by the National Rifle Association, Boy <br /> Scouts or Girl Scouts where air compression guns are used. <br />c. Games of skill at Carnivals, Fairs, or other Expositions where air <br /> compression guns are used in a safe and controlled manner. <br /> <br />(b) Nothing in this section shall be construed so as to prohibit any person from <br /> discharging any firearm in protection of his/her person, family, guests, or property. <br /> <br />(c) Any person violating the provisions of this section shall, upon conviction thereof, be <br /> punished in accordance with section !-7. <br /> <br /> <br />
