Resolution No. 1999- <br /> <br />RESOLUTION AUTHORIZING THE DONATION OF <br />SURPLUS PERSONAL PROPERTY ITEMS <br /> <br /> WltEREAS, Cabarrus County has possession of the items of personal property listed on <br />Exhibit A that are smplus to the needs of the County; and <br /> <br /> WHEREAS, many local governments in eastern North Carolina were devastated by the <br />floods from Hurricane Floyd and suffered extensive losses of routine operating equipment; and <br /> <br /> WHEREAS, North Carolina General Statute 153A-176 and 160A-274 sets forth <br />authority for the sale, lease, or exchange of personal property between governmental entities; and <br /> <br /> WHEREAS, the Cabarrus County Board of Commissioners desires to dispose of the <br />surplus personal property items listed on Exhibit A by donating said items to those local <br />governments in eastern North Carolina that were impacted by Hurricane Floyd and have an <br />identified need for the equipment. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Cabarrus County Board of <br />Commissioners as follows: <br /> <br /> (1) That in accordance with General Statute 153A-176 and 160A-274, this Board <br />authorizes the donation of the surplus property items identified on Exhibit A to specific local <br />govemments in eastern North Carolina with the County Manager to coordinate distribution <br />through the North Carolina Association of County Commissioners, the North Carolina League of <br />Municipalities or other governmental agencies; and <br /> <br /> (2) The Board directs the County Manager to file a written report with the Board <br />identifying the local govermnents and a description of the personal property items accepted by <br />each entity; and <br /> <br /> (3) The Board further directs that all surplus property items (Exhibit A)not accepted <br />by other local governments will be sold at public auction at a future date and time to be <br />established by the Board of Commissioners pursuant to General Statute 153A-176 and 160A- <br />270. <br /> <br />Adopted this the __ day of ,1999. <br /> <br />ATTEST: <br /> <br />Jeffrey L.
