WSACC <br /> SEWER AUTHORIT'/OF CASARf{U$ CO. <br /> <br />October 29, 1999 <br /> <br />Jonathan Marshall <br />Cabarrus County Planning Services <br />Post Office Box 707 <br />Concord, NC 28026-0707 <br /> <br />Subject: Moss Property on Rocky River Road <br /> <br />Dear Mr. Marshall: <br /> <br /> On October 20, 1999, staff of the Water and Sewer Authority of Cabarrus <br />County (WSACC) met with Randy Humphrey who is the potential developer of the <br />Rocky Meadows Subdivision on the Moss Property on Rocky River Road. The <br />agreements that were reached with Mr. Humphrey were verbal and tentative but will <br />very likely proceed with the County's con6urrence and f'mal approval of the WSACC <br />Board of Directors. ' <br /> <br /> Contingent upon Mr. Humphrey's successful purchase of the Moss property, <br />Mr. Humphrey has agreed to donate to WSACC the entire tract of property on the west <br />side of Rocky River Road. This tract is approximately 23 acres of which WSACC <br />requires approximately 13 acres for the Lower Rocky River Pump Station and Midland <br />Water Line Booster Pump Station. As part of this agreement, Mr. Humphrey will be <br />allowed to count the entire 23 acres as open space to increase the density on the <br />remaining property on the east side of Rocky River Road. We are aware that this is <br />subject to approval of the Planning and Zoning Board and the Cabarrus County <br />Commissioners. <br /> <br /> WSACC has filed condenmation that identifies the Moss' as the present owners <br />of the 13 acres and Mr. Humphrey as a potential purchaser by contract. Mr. <br />Humphrey has indicated that he would be willing to settle the condemnation provided <br />the density issue is approved by the County and if WSACC, on behalf of Mr. <br />Humphrey, would be willing to contribute $500 per lot for the fee the County may <br />require as part of approval of the development. This would amount to $71,000 based <br />upon the preliminary plat for the Rocky River Subdivision. If all parties were to agree <br />to the terms herein outlined, WSACC could cease the condemnation proceedings and <br /> <br /> <br />
