Ordinance No. 1999 - 08 <br /> <br /> AMENDMENT TO <br /> CABARRUS COUNTY CODE OF ORDINANCES <br /> CHAPTER 46 <br />OFFENSES AND MISCELLANEOUS PROVISIONS <br /> <br />BE IT ORDAINED that Section 46-2, Use of Firearms, of the Code of Ordinances, Cabarms County, <br />North Carolina is hereby amended to read as follows: <br /> <br />Section 46-2. Discharge of firearms. <br /> <br /> (a) It shall be unlawful for any person in the County to discharge any firearm or air <br />compression gun of any kind, nature, make, or description within a distance of 500 yards of any structure <br />occupied by any person except as follows: <br /> <br /> (1) Where the only structure occupied by any person located within 500 yards of the <br />discharge is owned or occupied by the person(s) discharging the firearm or air compression gun, <br />his/her immediate family, or his/her guest(s) with his/her written permission for such discharge at <br />such time. <br /> <br /> (2) By command ora military or law enforcement officer in the performance of official <br />duty or in the proper position for firing ceremonial salutes; <br /> <br /> (3) At or in a shooting range or gallery operated by a law enforcement agency or other <br />entity so authorized by the Board of County Commissioners; <br /> <br />(4) In an area zoned by the Board of County Commissioners to permit such discharge; <br /> <br /> (5) By securing a permit from the Sheriff granting exemption from this ordinance for <br />special occasions, authorization for which shall be in the sole and exclusive discretion of the <br />Sheriff or his express designee. <br /> <br /> (b) Nothing in this section shall be construed so as to prohibit any person from discharging <br />any firearm in protection of his/her person, family, guests or property. <br /> <br /> (c) Any person violating the provisions of this section shall, upon conviction thereof, be <br />punished in accordance with Section 1-7. <br /> <br />Adopted this __ <br /> <br />day of November, 1999. <br /> <br />ATTEST: <br /> <br />Jeffrey L.
