Section 16 - Permits <br /> <br />ao <br /> <br />No Person shall undertake any Land-Disturbing Activity subject to this <br />Ordinance without having first obtained a Plan Certificate and Letter of <br />Approval therefore from the County staff except that no Plan Certificate <br />and Letter of Approval shall be required for any Land-Disturbing <br />Activity: <br /> <br />1. For the purpose of fighting fires; or <br /> <br />For the stock piling of raw or. processed sand, stone, or gravel in <br />material processing plants and storage yards, provided that <br />Sediment control measures have been utilized to protect against off- <br />site damage; or <br /> <br />That does not exceed one (1) acre [except as provided in Section <br />6(a)(2) and (3)] in surface area. In determining the area, lands <br />under one or diverse ownership being developed as a unit will be <br />aggregated. <br /> <br />Although a Plan Certificate and Letter of Approval is not required <br />for activity comprising less than one (1) acre [except as provided in <br />Section 6(a)(2) and (3)], such activity shall be subject to all other <br />requirements of this Ordinance and any other applicable standards <br />or ordinances adopted by Cabarrus County. <br /> <br />b. The County may establish a review fee if considered necessary. <br /> <br />If the Person Responsible for the Violation begins a Land Disturbing <br />Activity and is found to be in violation for starting such activity prior to <br />obtaining a Plan Certificate and Letter of Approval, and such party has a <br />prior violation for the same offense, the review fee shall be doubled. If, <br />at any time, the Person Responsible for the Violation disturbs land outside <br />of the approved plan denuded limits and/or limits of construction, the <br />review fee shall be doubled. <br /> <br />Section 17 - Erosion and Sedimentation Control Plans <br /> <br />ao <br /> <br />Persons Conducting Land-Disturbing Activity shall be responsible for <br />preparing a Plan for all Land-Disturbing Activities subject to this <br />Ordinance whenever the proposed activity is to be Undertaken on a Tract <br /> <br />15 <br /> <br /> <br />
