RESOLUTION <br /> <br /> WHEREAS, representatives of the Midland community have informed the Cabarrus <br />County Board of Commissioners that citizens of that community wish to incorporate the Midland <br />area to include those individuals residing within the boundaries as outlined on the attached map; <br />and <br /> <br /> Wt~REAS, under current North Carolina law, a town may be incorporated only by act <br />of the North Carolina General Assembly subsequent to the review and recommendation by the <br />Joint Legislative Commission on Municipal Incorporations; and <br /> <br /> WglEREAS, North Carolina General Statute 120-163 outlines the procedures that a <br />community must follow in its efforts to incorporate, specifically a petition signed by 15 percent <br />of the registered voters of the area proposed to be incorporated and verified by the Cabarrus <br />County Board of Elections; and <br /> <br /> W'I:IEREAS, North Carolina General Statute 120-163 further requires that the petition <br />must include a proposed name for the city, a map of the city, a list of proposed services to be <br />provided by the proposed municipality, the names of three persons to serve as interim governing <br />board, a proposed charter, a statement of the estimated population, assessed valuation, degree of <br />development, population density and recommendations as to the form of government and manner <br />of election; and <br /> <br /> WltEREAS, the citizens of the Midland community are aware of the process for <br />incorporation and have stated their plan to submit the required petition and other necessary <br />information to the North Carolina General Assembly for consideration during the 2000 <br />Legislative Session. <br /> <br /> NOW, TI-IEREFORE, BE IT RESOLVED that the Cabarrus County Board of <br />Commissioners supports the rights of the citizens of the Midland community to pursue the <br />incorporation of Midland through the process set forth by North Carolina General Statutes. <br /> <br />Adopted this day of ,1999. <br /> <br />, Chair <br /> <br />ATTEST: <br /> <br />, Clerk of the Board <br /> <br /> <br />
