MEMORANDUM OF UNDERSTANDING between THE CITY OF CONCORD, THE CITY OF KANNAPOLIS, THE COUNTY OF CABARRUS, AND THE CABARRUS SOUTH ROWAN URBAN AREA METROPOLITAN PLANNING ORGANIZATION (MPO) FOR PREPARATION OF A UNIFIED DEVELOPMENT ORDINANCE (UDO) W1TNESSETH THAT WHEREAS, there is desirability to have the same Zoning and Subdivision Ordinances among all jurisdictions within Caba~:~us County in that common regulations would be favorable for citizens, developers and staff; and WHEREAS, the City of Concord entered into a decision to revise its Zoning Ordinance and Subdivision Regulations, through the use of a planning consultant; and WHEREAS, the City of Kannapolis and Cabarrus County have agreed to participate in the selection of the consultant and in the preparation of both a Zoning Ordinance and Subdivision Regulations into one document, known as a "Unified Development Ordinance: or "UDO;' and WHEREAS, after interviews and deliberations, the jurisdictions have selected Freilich, Leitner, and Carlisle (hereafter known as "FLC") of Kansas City, Missouri to prepare the UDO, and WHEREAS, the City of Kannapolis and Cabarrus County have agreed to contribute funding for compensation of FLC; and WHEREAS, part of the scope of the UDO will include regulations for the provision of adequate public facilities, which will include roads and transportation; and WHEREAS, drafting and adoption of these provisions of the UDO will forward the transportation planning goals and the mission of the MPO; and WHEREAS, the MPO has in its Planning Work Program available funding for Collector Street Planning, Administrative Controls, and Corridor Planning, which will be part of the UDO. NOW, THEREFORE, the parties hereto do mutually agree as follows: SECTION 1: It is hereby agreed that the City of Concord will act as lead agency in the development of the UDO, and shall be responsible for the compensation of the consultant, as specified in the approved contracL SECTION 2: It is hereby agreed that the project shall consist of at least four phases, with Phase I of the project beginning immediately, and with Phase II ending on June 30, 1998.
