To avoid unnecessary costs and make the best <br />use of resources already in place at the State, electing countles must be <br />permitted to use the state hearings and appeals process for ail issues <br />except those arising from unique eligibility requirements the electing <br />county has developed. <br /> <br />Understandings= <br />1) Change of Status: The County may change to standard status at a later time <br /> upon action of the Soard of Commissioners. (It ls understood that the <br /> County may request a change in status at least until the General Assembly <br /> has approved the State's Block Grant Plan.) <br />2) Use of Sate Systems= As Cabarrus County proposes to follow State policies <br /> regarding eligibility and payment levels, except in the use of a 'pay for <br /> performance" system, Cabarrus will be able to utilize the State Ellg£bility <br /> Information System and the State will issue public assistance checks for the <br /> County. <br />3) Agent of the State= As the State will approve the County's Block Grant Plan <br /> prior to its implementation, the County will be considered to serve as an <br /> agent of the State in its administration of programs under the plan in the <br /> same sense that a standard county would be considered an agent of the State. <br /> <br />Other A~enda Items <br /> <br /> The Board agreed to consider the remaining items on the agenda at s recessed <br />meeting. These items included: Proposed Cable Ordinance and Franchise Agreement <br />with Time Warner Cable, Inc. - First Reading (Set Public Mearing for February <br />Meeting); Expansion of Leased Property at Frask Liske Park from the State; <br />Retirement of Terry Rowland - Filling Tax Administrator Position; Closed Session <br />to Discuss the Performance Evaluation of the County Manager as Authorized by <br />North Carolina General Statute 143-318.11(a)(6); and Appointments to the cabarrus <br />County Parks and Recreation Cor~nission; Firemen's Relief Fund Trustees; Cabarrus <br />County Planning and Zoning Commission; Cabarrus County Tourism Authority; Adult <br />Care Ho~e Community Advisory Committee; Department of Aging Advisory Board; and <br />Transportation Advisory Committee of the Cabarrus/South Rowan Urban Area <br />Metropolitan Planning Organization (Commissioner Member). <br /> <br />REPORTS <br /> <br /> The Board received the following reports in agenda package. (1)Annual RepOrt <br />for FY 1996-97 on Cabarrus County Parks, Recreation and Property Maintenance <br />Department; (2} Award of Grant by the Cannon Foundation to the Cabarrus Health <br />Alliance - Sisters in Partnership; and (3) Update on Worker's Compensation <br />Medical Expense/Savings for Cabarrus County. <br /> <br />CLOSED SESSION <br /> <br /> UPON MOTION of Commissioner Barnhart~ seconded by Con%missioner Carpenter and <br />unanimously carried, the Board moved to go into closed session to discuss pending <br />or threatened litigation involving Philip Morris and Lake Concord Venture as <br />authorized by North Carolina General Statutes 143-318.11(a)(3). <br /> <br /> UPON MOTION of Commissioner Carpenter, seconded by Commissioner Mills and <br />unanimously carried, the Eoard moved to terminate the closed session. <br /> <br />Release and Settlement A~reemsnt <br /> <br /> UPON MOTION of Commissioner Mills, seconded by Commissioner Barnhart and <br />unanimously carried, the Board approved the Release and Settlement Agreement. <br /> <br />RELEASE AND SETTLEMENT AGREEMENT <br /> <br /> THIS RELEASE AND SETTLEMENT AGREEMENT is entered into by and between the <br />respective parties on January 20, 1998. <br /> <br /> 1. pARTIES.
