Hartsell, Jr., County Attorney <br /> <br />RE: Highland Creek Subdivision <br /> <br />Attached is Jonathan Marshall's review of the latest response from Highland Creek developers. <br /> <br />I concur with Jonathan's point of view. I believe we should advise them that staffwill bring this issue <br />to the Board of Commissioners as early as the March meeting. We will recommend approval of the <br />first phase "as is." We will then suggest the Planning Commission apply the "adequate public <br />facilities" provision to further considerations. <br /> <br />I would also suggest the Planning Commission take action to make sure any subdivision submittals <br />deal directly with the County line issue. The developer should make sure that the county line imposes <br />no "unique" hardships on lot purchases. <br /> <br />Finally, and I believe Highland Creek has previously agreed, that n__o_o building shall take place until <br />access roads fi.om Cabarrus County are in place and complete. Emergency response to construction <br />accidents needs to be assured. <br /> <br />Please advise Bob Bradshaw of our position.
