Marshall, Planning Services Director <br /> <br />DATE: March 9, 1998 <br /> <br />SUBJECT: Kannapolis Request for Extraterritorial Jurisdiction <br /> <br />The attached letter and resolution are a request from the City of Kannapolis for <br />extension of extraterritorial jurisdiction in their Area I annexation. <br /> <br />I have reviewed this request and am recommending that you consider a resolution, also <br />attached, to grant this request. There are some concerns with granting this request, but <br />the Kannapolis City Council and staff have made assurances that will address these <br />concerns. Some of the issues that we have discussed include: <br /> <br />1) <br /> <br />Protection of non-residential areas. Despite some statements to the contrary there <br />are considerable non-residential districts within Area I. Kannapolis has indicated <br />through their resolution and in conversation, however, that they will protect and <br />possible increase the non-residential zoning. <br /> <br />2) <br /> <br />Protection of the Wes[side Bypass corridor. The County currently protects the <br />corridor of the Wes[side Bypass through the Thoroughfare Overlay Zone provisions <br />of the Coun.ty Zoning Ordinance and has been doing so since 1988. Kannapolis <br />staff has indicated that they have already made provisions in their zoning ordinance <br />to continue to protect the planned road corridor. <br /> <br />3) <br /> <br />Continuation of shared city/county services. The County currently provides <br />building inspection and sediment and erosion control services in Area I. The <br />resolution from the Kannapolis City Council indicates they will continue to contract <br />for building inspection services. I have also included the continuation of sediment <br />and erosion control services in the resolution from the Board of Commissioners <br />agreeing to the extraterritorial jurisdiction extension. <br /> <br /> Planning Services Division <br /> <br />P.
