Being Lots Nos. 43 through 66 and a part of Lot No. <br />42 in Block "C", as shown on the map of the J. W. <br />CHISHOLM PROPERTY, a map of said property being on file <br />in the office of the Register of Deeds in Book of Maps at <br />page 422 and described as follows (new description): <br /> <br /> BEGINNING at a stake at the northeastern corner of <br />the intersection of Mountain Circle (formerly known as <br />Callie's Circle and Mountain Street) and West 8th Street <br />(formerly known as Whitley Street and 8th Street) and <br />runs thence N. 24-15-35 W., 222.30 feet with the eastern <br />edge of Mountain Circle to a new iron pipe, corner of <br />Lots Nos. 50 and 51 in the bend of said street; thence N. <br />77-29-47 W., 177.83 feet with the northern edge of <br />Mountain Circle to a stake at the northeastern corner of <br />the intersection of Mountain Circle and Glenn Avenue; <br />thence N. 13-21-20 E., 384.07 feet with the eastern edge <br />of Glenn Avenue to a computed point (said point being N. <br />71-30-29 W., 11.01 feet from an existing iron rod); <br />thence S. 71-30-29 E., 137.68 feet to a 20" hickory, an <br />old corner of the Flowe land; thence S. 10-31-10 E., <br />181.27 feet to an existing 1/2" iron rod, an old corner; <br />thence S. 24-15-35 E., 363.40 feet to a computed point in <br />the center of West 8th Street; thence S. 65-44-25 W., <br />150.00 feet to the BEGINNING, containing 2.601 acres~ as <br />surveyed and platted by Mel G. Thompson, RLS, on the 8th <br />day of April, 1991, a copy of which is attached hereto <br />marked "Exhibit A" and incorporated herein by reference. <br /> <br />The property hereinabove described was acquired by Grantor by <br /> <br />instrument recorded August 16, 1972, in Deed Book 552, Page 957, of <br /> <br />the Rowan County Registry. <br /> <br />A map showing the above-described property is recorded in Book <br /> <br />of Maps, Page 422. <br /> <br />TO HAVE AND TO HOLD the aforesaid lot or parcel of land and <br /> <br />all privileges and appurtenances thereto belonging to the Grantee <br /> <br />in fee simple. <br /> <br />And the Grantor covenants with the Grantee, that Grantor is <br /> <br />seized of the premises in fee simple, has the right to convey the <br /> <br />same in fee simple, that title is marketable and free andclear of <br /> <br />all encumbrances, and that Grantor will warrant and defend the <br /> <br />title against the lawful claims of all persons whomsoever except <br /> <br /> <br />
