July 30, 1997 <br /> <br />Dear Neighbors, <br /> <br /> On July 25, 1997 t had a conversation with Mr. Alvin Hough who is in <br />charge of road paving in the District Office of the D.O.T. in Albemarle. His <br />telephone # is (704) 982-0104. <br /> Here is what I learned: <br /> <br />> On either side of the center: 10 feet will be paved totaling 20 feet of <br /> pavement <br /> 6 foot wide shoulders <br /> 5 foot wide ditches <br />8 foot wide backslopes (connects property to <br />ditches) <br />This leaves 1 foot between our property and the right of way they may or <br />may not touch. <br /> <br /> The property owner is responsible for removing things in the right of <br />way such as septic tank lines. <br /> <br />They will try to work with the property owner if it is in reason in trying <br />to avoid trees, etc. if they are in the backslope area. Not a whole lot they <br />can do if they are in the paving, shoulder or' ditch areas. <br /> <br />The Right of Way Agreement that was signed by the previous property <br />owners May 1, 1968 is binding. The present property owners are referred <br />to as successors or assigns. We are bound to this agreement which was <br />made by people, of which the majority are no longer living, whether we <br />agree with it or not. <br /> <br />Once the State has obtained Right of Way, they are in full control unless <br />an Attorney can find a loophole that may negate the Right of Way <br />Agreement. <br /> <br />The D.O.T. runs by fiscal year. Their year has just begun...ming from <br />July '97-June '98. Edgefield Road is targeted to be paved sometime <br />between July '98 and June '99. The surveying was done now becaUse of <br />shortage of manpower on the survey crews. Property owners will have to <br />live with the stakes. <br /> <br /> <br />
