J^M[S B. HUNT IR.
GOVERNOR

.STATE OF NORTH CAROLINA
DEPARTMENT OF TRANSPORTATION
DIVISION OF HIGHWAYS
May 7, 1998

E..NoRms TOLSON
SECRET^R¥

Mr. George R. Barnard
7154 Edgefield Road
Concord, N. C. 28025

Subject: Paving SR 1190 (Edgefield Road) in Cabarms County

Dear Mr. Barnard:

Reference your letter to me dated May 4, 1998 concerning the above subject. In your
letter you address several items and I shall try to address them as best I can.

Several months ago we received a petition from some of the property owners on Edgefield
Road requesting it not to be paved. I had told someone on the telephone that if all of the
property owners signed a petition requesting it not bepaved, I would check to see if there
was a way we could skip the road. There are some people on the road who do want it
paved. I did check to see if we could skip the road and was advised that we could not ·
because we already have the necessary right of way. I notified the first petitioner that we
could not skip it and considered the matter closed.

I did present the entire paving program for Cabarrus County, including Edgefield Road, to
the C~ounty Commission on April 20, 1998. I did not directly notify you or others on this;
or any other road, of this. However, the program was posted on the county bulletin board
and the fact I was presenting the program was advertised in the newspaper for two weeks
prior to April 20, 1998.

If the County Commission, at that time, chose not to pave the road they would have to
have had a public hearing.

Some people on Edgefield Road contacted our Raleigh office requesting the road not be
paved. I was advised on April 27 or 28, 1998 of the provision of the taw which may allow
us to skip the road if the County Commission held a public hearing and passed a resolution
requesting the road not be paved. The Board of Transportation will also have to approve
not paving the road.

615 Concord Road, Albemarle, N.C. 28001 (704) 982-0104 Fax (704) 982-9659
