David Bruton, M.D., Secretary (919) 733-3055 <br />April 16, 1998 <br /> <br />Dear Cabarrus County Board of Commissioners Chairman: <br /> <br />Our records indicate that the term of Dr. Frank Niblock who was appointed by the County <br />Commissioners and is presently serving as a member of the Cabarms County Board of Social Services <br />expires June 30, 1998. <br /> <br />Information regarding the limitation of terms is as follows: <br /> <br />G.$. 108A-4: "Each member of a county board of social services shall serve for <br />a term of three years. No member may serve more than two consecutive terms. <br />Notwithstanding the previous sentence, the limitation on consecutive terms does <br />not apply if the member of the social services board was a member of the board <br />of coanty commissioners at any time during the first two consecutive terms, and <br />is a member of the board of county commissioners at the time of reappointment. " <br /> <br />In summary, ifa social services board member has served two consecutive terms but is a county <br />commissioner on June 30, 1998, that person may be reappointed. <br /> <br />G.S. I08A-6: All appointments that were made to fill vacancies "... shall be for <br />the remainder of the former member's term of office and shall not constitute a <br />term for the purposes of G. S. 108.4-4." <br /> <br />In order to update our records, please use the attached form to notify us of the person appointed to fill <br />this position. The term of this appointment will be July 1, 1998 - June 30, 2001.
