OF <br /> <br /> THIS OPTION T~'~CHASE',a'~ade as of the 21st day of June, <br />1993, between Tere~i~.'-.Eu4y'.(~married), hereinafter referred to <br />as Seller, to Cabarrus County, a body politic and political <br />subdivision of the State of North Carolina, hereinafter referred to <br />as Buyer; <br /> <br />W I T N E S S E T H: that -- <br /> <br /> The Seller, for good and valuable consideration in hand paid <br />to her by Buyer, receipt of which is hereby acknowledged, does <br />hereby give and grant unto Buyer, its successors, assigns, or <br />representatives, the exclusive right and option to purchase that <br />certain permanent, non-exclusive right-of-way and easement 20 feet <br />in width for ingress,' egress and regress to, from and over the <br />following property located on the south side of N. C. Highway 73, <br />Cabarrus County, North Carolina, more particularly described as <br />follows (the "Property"): <br /> <br /> BEGINNING at the Easement Stake No. 1 (the location <br />of which is identified in that Deed for 3.066 acres from <br />Cabarrus County to Teresa B. Eudy of even date herewith <br />to which reference is hereby made); thence'S;- 80-i8-45. <br />E., 20.65 feet to a new iron stake,"new'.corner of~Eudy <br />and Cabarrus County in the former Baxter property;ithence <br />two (2) lines with Cabarrus County as follows: (1) S. 4- <br />44-58 E., 234.26 feet to a new iron stake; '(2)-S%'24-05= <br />22 W., 83.46 feet to a new iron stake; thence through <br />Eudy, a new line, S. 76-47-46 W., 197.66 feet to a new <br />iron stake in the former Eudy/Baxter line; thence with <br />the former Eudy/Baxter line, N. 2-52-04 E., 20.81 feet to <br />a new iron stake, the Easement Stake No. 2; thence three <br />(3) lines through Eudy as follows: (1) N. 76-47-46 E., <br />181.99 feet to a point; (2) N. 24-05-22 E., 68.41 feet to <br />a point; (3) N. 4-44-58 E., 234.27 feet to the BEGINNING. <br /> <br />The terms and conditions of this option are as follows: <br /> <br /> 1. Term. This option shall be for a period of f~ve (5) years <br />and shall ~st and continue until 11:59 o'clock P.M,'on the 20th <br />day of June, 1998. <br /> <br /> 2. Exercise. At any time during the option period, Buyer may <br />exercise this option by hand delivery or deposit of written notice <br />by certified or registered mail, return receipt requested, to <br />Seller at the following address: P.
