C. 28025 <br /> <br />Subject: Paving SR 1190 (Edgefield Road) in Cabarrus County <br /> <br />Dear Mr. Barnard: <br /> <br />Reference your letter to me dated May 4, 1998 concerning the above subject. In your <br />letter you address several items and I shall try to address them as best I can. <br /> <br />Several months ago we received a petition from some of the property owners on Edgefield <br />Road requesting it not to be paved I had told someone on the telephone that ifaltofthe <br />property owners signed a petition requesting it not be paved, I would check tas. ee i£there. <br />was a way we could skip the road. There are some people on the road who do want it <br />paved. I did check to see if we could skip the road and was advised that.we-could not <br />because we already have the necessary right of way. I notified the first petitioner that <br />could not skip it and considered the matter closed. <br /> <br />I did present the entire paving program for Cabarrus County, including Edgefield Road, to <br />the C~ounty Commission on April 20, 1998. I did not directly notify you or others on this; <br />or any other road, of this. However, the program was posted on the county bulletin board <br />and the fact I was presenting the program was advertised in the newspaper for two weeks <br />prior to April 20, 1998. <br /> <br />If the County Commission, at that time, chose not to pave the road they would have to <br />have had a public hearing. <br /> <br />Some people on Edgefield Road contacted our Raleigh office requesting the road not be <br />paved. I was advised on April 27 or 28, 1998 of the provision of the law which may allow <br />us to skip the road if the County Commission held a public hearing and passed a resolution <br />requesting the road not be paved.
