JAMES B, HUNT JR.

STATE OF NORTH CAROLINA
DEPARTMENT OF TRANSPORTATION
DIVISION OF HIGHWAYS
April 28, 1998

E. NORRIS TOLSON
SECRL:T^RY

Property Owners on Edgefield Road

Subject: Paving SR 1190 (Edgefield Road) in Cabarms CoUnty

Dear

The paving ofSR 1190 (Edgefield Road) in Cabarrus County is included in our paving
program for the Fiscal Year 1998-1999. This program has been approved by the Cabarrus
County Commission and is expected to be approved and funded by the N. C. Board of
Transportation in July 1998. We already have the right of way necessary to pave the road,

We have received a petition signed by several 0fthe property owners requesting the road
not be paved. State law does not allow us to arbitrarily skip roads on our paving priority
list. Due to the fact we already have the necessary right of way; we Cannot' use the
inability to acquire right of way as a reason not to pave it.

I have been advised that the only legal way we can skip paving the road is for the Cabarrus
County Commission to hold a public hearing and pass a resolution requesting the N. C.
Board of Transportation not pave the road. It must then be submitted to the N. C.
Department of Transportation for their review. If the Board of Transportation approves
the request the road can be skipped and left unpaved.

Due to the above, and the fact it is expected to be funded in July, those who do not want
Edgefield Road paved should quickly contact the County Commission and request the
hearing. Those who do want the road paved should also contact the County Commission
so that everyone's views can be heard.

615 Concord Road, Albemarle, 5/.('. 28001 (704) 982-0104 Fax (704) 982-9659
