<br />~ Ca~ina, hereinafter referred to as "GRANTOR" (whether singular or plural), and Cae Town of Mt
<br />Pleasan~'a municipal corporation of Cae State of North Carolina, hereinafter referred to as Cae "TOWN";

<br />WITNESSETH: that--

<br /> FOR AND IN CONSIDERATION of One Dollar ($1.00) and other good and valuable
<br />consideration in hand paid by the TOWN to GRANTOR, Cae receipt whereof is hereby acknowledged,
<br />GRANTOR does hereby give, grant and convey unto the TOWN, its successors and assigns, a pa~etual
<br />Right-of-Way and Easeraent of no more than twenty (20) feet in width to go in and upon GRANTOR'S
<br />real property located in No. 8 Township, Cabarrus County, North Carolina, as more particularly described
<br />in a survey and map by Mai G. Thompson, RLS attached hereto as "Exhibit A" and incorporated herein by
<br />
<br /> AND TO CONSTRUCT, MAINTAIN AND OPERATE in, upon and through said premises a
<br />utility line(s) (water, sewer, or otherwise), with all necessary pipes and/or appurtenances, together with Cae
<br />right at all times of ingress, egress, and regress thereto, and the right of entry upon said premises for Cae
<br />purpose of inspecting said line(s), making repairs or alterations Cacrenn, and/or clearing obstructions that
<br />may, in the opinion of the TOWN, endanger or interfere with the proper maintanance and operation of the
<br />
<br /> TO HAVE AND TO HOLD the afuresaid Right-of-Way and Easement unto the TOWN, its
<br />suee~ors and assigns forever;
<br />
<br /> AND THE GRANTOR, for GRANTOR, GRANTOR'S heirs, successors, personal
<br />representatives and assigns, does hereby covenant the TOWN, its successors and assigns, that GRANTOR
<br />is seized of cae premises in fee simple, that said premises are flee fi-om all encumbrances, that GRANTOR
<br />has good right and lawful authority to sell cae same; and that GRANTOR will warrant and defend cae said
<br />premi~ unto the TOWN, its successors and assigns, against cae lawful claims of all persons whomsoever.
