Name(s) and address(es) of ali abutting property, owners, including <br />all on site easement holders. <br /> <br />3. A legal description of the proposed rezoning. <br /> <br /> If rezonlng to an "SU" district is desired, petitioner also submits a <br />development plan as described in Section 13-11, part 3 at this time. <br /> <br /> · Step 2: Staff Review. The Planning and Zoning Department staff review the <br />submitted application. If the rezoning is to an "SU" district, the staff also reviews <br />the proposed development plan. After review, the staff will again meet with the <br />petitioner to discuss its recommendation. The petitioner may refuse or accept <br />staff recommendations. <br /> <br />~ 'Step 3: The Planning and Zoning Commission. The Planning and Zoning <br />'(['~ommission will consider all applications to amend the atlas or text of this <br />Ordinance at their regularly scheduled monthly meetings. Applications must be <br />filed thirty. (30) days prior to the regularly scheduled monthly meeting so that staff <br />evaluations can be accomplished. Applications along with respective staff <br />evaluations must be submitted to the Planning and Zoning Commission at least five <br />(5) days prior to the regular monthly meeting date. <br /> <br /> · Step 4: Planning and Zoning Commission Recommendations to Commissioners. <br /> Within forty, (40) days of hearing the presentation of the application to amend, the <br /> Planning and Zoning Commission shah make a decision on the rezoning petition. A <br /> special use rezoning decision shall be supported by findings of fact arrived from <br /> sworn testimony preseni~l at the official public hearing held by the Planning and <br /> Zoning Commission. The Planning and Zoning Commission decision shall be <br /> considered the final action if the vote to approve or deny the request is of at least <br /> three~ fourths of the Planning and Zoning Commission members present and not <br /> excused from voting and if no appeal of the decision is made. <br /> <br /> · Step 5: Commissioner's Public Hearing (if nccded). If an approval or denial <br />is by a vote of less than three fourths of the members of the Planning and Zoning <br />Commission or ff an appeal is taken, then the County Commissioners shall make the <br />final decision on the rezoning petition. Any person aggrieved by the <br />recommendation of the designated planning agency shall have the right to appeal <br />the action of the Planning and Zoning Commission to the Coun .ty Commissioners by <br />giving notice in writing to the County Manager within fifteen (15) days of the action <br />of the planning agency. In the case of an appeal, the Board of Coun~ <br />Commissioners shall hear the application de novo (anew). <br /> <br />13-5 <br /> <br /> <br />
