Ordinance No. 1998-09

PETITION C98-02(T)

AN ORDINANCE AMENDING THE CABARRUS COUNTY
ZONING ORDINANCE
BE IT ORDAINED that the Cabarrus County Zoning Ordinance is hereby amended as
follows:

Flexible Front Setbacks for the MDR District's Customized Development Standards

On Monday, June 15, 1998, the Board of Commissioners passed an amendment to the
Zoning Ordinance providing developers some additional flexibility in their subdivision
design pertaining to the MDR district's customized development standards. The
amendments focuses on the front setbacks only.

From three suggestions presented to the Board, Suggestion 2 was selected as follows:

Suggestion 2:

Allow the developer to use flexible front setbacks for a percentage of the property
while maintaining the 30' front setback for the remainder of the development.

Although the Board supported the intent of the amendment, it did not choose the specific
percentage ora development that would be subject to flexible front setbacks.

Staff's recommendation is that 50% of the lots in a given development should be allowed
to use flexible fi-ont setbacks while the remaining 50% of the lots should be subject to the
existing 30' setback requirement. The specific language of the amendment as staff
recommends is italicized below:

-Front... 50% flexible; 50% 30'
-Side... flexible
-Rear...flexible

Since this amendment was already advertised and a public hearing held, the Board does
not need to hold an additional public hearing.

Adopted this the __ day of
Commissioners.

, 1998 by the Cabarrus County Board of

ATTEST:

Sue B.
