627 <br /> <br />developer to use flexible front setbacks for a percentage of his property <br />while maintaining the 30-foot front setback for the remainder of the <br />development. <br /> <br />Amendments to the Cabarrus County Flood Damage Prevention Ordinance Relative <br />to Specific Standards for Floodway Fringe Permitted Uses - Public Hearin~ - <br />6:30 P.M. <br /> <br /> Mr. Jonathan Marshall, Planning Services Director, reviewed the proposed <br />amendment to the Flood Damage Prevention Ordinance. <br /> <br /> Vice-Chairman Carpenter opened the public hearing at 7:00 P.M. and asked <br />if anyone wished to speak either for or against the proposed amendment. There <br />was no one present to address the Board, and Vice-Chairman Garpenter closed <br />the public hearing. <br /> <br /> UPON NOTION of Commissioner Barnhart, seconded by Commissioner Niblook <br />and unanimously carried, the Board adopted the following Ordinance Amending <br />the Cabarrus County Flood Damage Prevention Ordinance. <br /> <br />PETITION C98-01 (FDPO) <br /> <br />Ordinance No. 1998-10 <br /> <br />AN ORDINANCEAMENDINGTHE CABARRUS COUNTY <br />FLOOD DAMAGE PREVENTION ORDINANCE <br /> <br />BE IT ORDAINED that the Cabarrus County Flood Damage Prevention Ordinance is <br />hereby amended as follows: <br /> <br />Chapter 38, Article II, Section 38-26 et. seq. of the Code of Ordinances, <br />Cabarrus County, North Carolina is hereby amended as follows: <br /> <br />Section 38-29 "Objectives" <br /> Add number 8 to maintain the natural storage capacity of the floodway <br />fringe area. <br /> <br />Section 38-77 "Specific Standards," Number 9~ "Floodway Fringe Permitted Uses" <br />part (a)(2) add: <br /> <br /> "All material used as fill within the floodway fringe must be derived <br />from adjacent floodway fringe and the same deeded parcel as that area being <br />filled. The net result of borrow and fill within the floodway fringe area <br />shall constitute no net loss to the flood storage capacity of the floodway <br />fringe. A professional engineer must certify that no net loss of storage will <br />occur as a result of the fill activity." <br /> <br />Adopted this the 15~ day of June, 1998 by the Cabarrus County Board of <br />Commissioners. <br /> /s/ Sue B, Casper <br /> Sue B. Bonds, Clerk to the Board <br /> <br />Pavinm of Edmefield Road (SR 1190) - Public Hearing - 6:30 P.M- <br /> <br /> Vice-Chairman Carpenter opened the public hearing concerning the paving of <br />Edgefteld Road (SR 1190) at 7:02 P.M. The Notice of the public hearing was <br />published in THE INDEPENDENT TRIBUNE and THE CHARLOTTE OBSERVER (Cabarrus <br />Neighbors) on May 31, 1998. <br /> <br /> Ms. Marry Crawford, resident of 7475 Edgefield Road, spoke against the <br />paving of Edgefteld Road and cited the following reasons against paving: (1) <br />The road is in excellent condition; (2) The gravel road discourages traffic <br />and acts as a warning alarm for residents; (3) The Department of <br />Transportation will not have adequate maintenance funds to properly maintain a <br />paved road; (3) Heavy machinery used during the paving process may damage her <br />well located close to the right of way; (4) Trees along Edgefield should not <br />be cut; and (5) Dust from the dirt road poses no health hazards- for those <br />persons with allergies or asthma. In conclusion, she stated there are 13 <br />property owners on Edgefield Road with nine against paving and four in favor. <br /> <br /> Mr. George R. Barnard, resident of 7154 Edgefield Road, opposed the paving <br />of Edgefleld Road. He distributed statements from the following officials in <br /> <br /> <br />
