4. Publication and Publicity. The Subcontractor may publish results of its function and <br />participation in the approved State Plan without prior review by the Subgrantee, provided that all <br />such pubficatJons, interviews, news releases, and other communications of similar nature contain <br />the following language: <br /> <br />"Sponsored by Oabaruss Courtly Departmenf; of Aging, in cooperation with lhe North Carolina <br />Energy Division, Department of Commerce and Sa/isbuw-Rowan Community Se,~vice Council, <br />Inc., with funds granted by the Weatherization Assistance Pre. gram, pursuant to Part A, Title IV of <br />the National Energy Conservation Policy Act (NECPA) Public Law 95-619. However, any opinions, <br />findings, conclusions, or recommendations expressed herein are those of the author(s) and do not <br />necessarily reflect the views of the U.S. Department of Energy, the North Carolina Department of <br />Commerce, or Salisbury-Rowan Community Service Council, inc." Three copies of each such <br />publication, interview, news release or other communication shall be furnished to the Subgrantee. <br /> <br />5. Cooyrights. If the Contract results ih a book or other copyrightable material, the author is free <br />to copyright the work, but the DOE and the Grantee reserve a royalty-free, nonexclusive and <br />irrevocable license to reproduce, publish, or otherwise use, and [o authorize others to use, all <br />copyrighted material and all ma[oriel which can be copyrighted resulting from the Contract. <br /> <br />6. Patents.. Any discovery or invention arising out of or deve!oped in the course of work aided by <br />this Contract shall be promptly and fully reported to the Grantee and Subgrantee for determination <br />as to whether pa~ent protection on such invention or discovery shall be sought and how the rights <br />in the invention cr discovery, including rights under any patent issued thereon, shall be disposed of <br />and administered, in order to protect the public interest. <br /> <br />7. Covenan¢ A9ains~ Contingent Fees. The Subcontractor warrants that no .person or selling <br />agency or other organization has been employed or retained to solicit or secure this Contract upon <br />an agreement or understanding for a commission, percentage, brokerage, or contingent fee. For <br />breach or violation of this warrant, the Subgrantee shall have the right to annul this Contract <br />without liability or, in its discretion, to deduct from the compensation, or otherwise recover, the fuji <br />amount of such commission. <br /> <br /> 8. Discrimination ~ Emoloyment Prohibited. The Subcontractor will not discriminate against any <br /> employee employed in the performance of this Contract, or against any applicant for employment <br />-- in the performance of this Contract because of race, sex, age, creed, color, physical ha.ndicap or <br /> national odgJn. The Subcontractor will. take affirmative action to ensure that applicants are <br /> employed, and that employees are treated during employment, without regard to race, sex, age, <br />-- creed, co[or, physical handicap or nadonal origin. This requirement sha¢l apply to, but not be <br /> limited to, the following: employment, upgrading, demotion, or transfer; recruitment or recruitment <br /> advertising; layoh' or termination; rates of pay or other forms of compensation; and selection for <br /> -- training, including apprenticeship. In the event that the Subcontractor signs any contract which <br /> would be covered by Executive Order 10925 ('March 6, 1961) or Executive Order 11114 (June 22, <br /> 1963), the Subcontractor shall include the equal-employment opportunity clause specified in <br /> -- section 301 of Executive Order 10925, as amended.
