ARTICLE II <br /> <br />Certain Responsibilities of Political Subdivision <br /> <br /> Section 2.1. Delivery of Sewage. Except as provided below, Cabarrus shall deliver to <br />WSACC all sewage collected by it through its sewer system and shall not provide for the <br />disposal of sewage collected by it in any other manner. Cabarrus shall be responsible for the <br />acquisition, construction, operation, maintenance and financing of all sewers and other facilities <br />for the collection and delivery of sewage to WSACC, except to the extent that WSACC <br />expressly agrees to share such functions or their costs. <br /> <br /> Cabarrus will notify WSACC in writing and, upon request, confer with representatives of <br />WSACC before commencing with the design of or any other work relating to any expansion or <br />improvement of its sewer system, except for routine maintenance, including repair and <br />replacement, of such system. <br /> <br /> Cabarrus will also notify WSACC in writing and, upon request, confer with <br />representatives of WSACC before agreeing to accept the sewage of any other political <br />subdivision or other public entity which additional sewage would have to be treated by WSACC. <br /> <br /> If Cabarrus is advised by WSACC that WSACC is unable to accept additional sewage <br />because of insufficient capacity of the Sewer Facilities, then Cabarrus shall temporarily <br />temdnate the issuance of permits which allow the start of construction within its jurisdiction or <br />shall not agree to accept the sewage of any' other political subdivision or other public entity, as <br />may be applicable, until (a)such capacity is sufficiently increased by WSACC, (b) adequate <br />alternative sewage disposal arrangements are made by WSACC, (c)Cabarrus is advised by <br />WSACC that Cabarrus nevertheless may deliver additional sewage to WSACC or (d) Cabarrus <br />provides for alternative sewage disposal arrangements as hereinafter provided and such <br />arrangements are in effect. <br /> <br /> Cabarrus shall not acquire, construct, use or otherwise provide for any sewage disposal <br />facilities other than those of WSACC except to the extent that; <br /> <br /> (a) WSACC cannot meet or otherwise provide for the sewage disposal needs of <br />Cabarrus, except for any temporary interruption of service, in which case Cabarrus may acquire, <br />construct, use or otherwise provide for any sewage disposal facilities other than those of <br />WSACC to the extent necessary to dispose of sewage collected by it which WSACC cannot <br />dispose of or make other provision for, and Cabarrus shall otherwise continue to deliver sewage <br />collected by it to WSACC as provided in this Agreement; or <br /> <br />(b) WSACC agrees to such alternative sewage disposal arrangement; or . <br /> <br /> (c) Cabarms acquires, constructs or operates any sewage collection system in a <br />drainage basin outside Cabarms County which is not directly or indirectly tributary to the Rocky <br /> <br />5 <br /> <br /> <br />
