WHEREAS, pursuant to the Agreement, the Counties agreed to execute deeds <br />for the Real Property and transfer documents for personal property as may be necessary <br />and appropriate for the transfer of fee simple title to the Park, its facilities and related <br />personal property free and clear of all liabilities, claims, obligations, security interests <br />and encumbrances; and <br /> <br /> WHEREAS, beginning on January 1, 1999, the City of Kannapolis, under the <br />provisions of the Agreement did agree to act as lead agency for the management and <br />operation of the Park which activities shall include, but shall not be limited to, the <br />following: <br /> <br /> (a) Acting as the Park's purchasing agent for all supplies, <br /> <br /> (b) Providing accounting and other fiscal control in compliance with those <br />procedures identified in North Carolina General Statutes Chapter 159, <br /> <br /> (c) Providing an annual audit of the Park's budget and expenditures as <br />required by the North Carolina Local Government Commission, <br /> <br /> (d) Providing or performing such other services and activities as the City and <br />Cabarrus County may agree; and <br /> <br /> WHEREAS, the Park Commission was greatly aided in its efforts to establish the <br />Park through two Federal Grants for Capital Improvement from the Land and Water <br />Conservation Funds of the United States Department of Interior and the National Park <br />Service as well as a State Grant for Capital Improvement from the North Carolina <br />Parks and Recreation Trust Fund; and <br /> <br /> WHEREAS, the Cannon Mills Company generously donated a substantial <br />portion of real property used by the Park Commission to establish the Bakers Creek <br />Park; and <br /> <br /> WHEREAS, Atlantic American Properties generously donated a substantial <br />portion of real property used by the Park Commission to establish the Bakers Creek <br />Greenway; and <br /> <br /> WHEREAS, the leadership and support of the members of the Cabarrus-Rowan <br />Park Commission has been invaluable in the successful culmination of this project; and <br /> <br /> WHEREAS, the financial support provided by the Federal' and State grants, the <br />combined support of Cabarrus County, Rowan County and the City of Kannapolis <br />together with the generosity of private companies, businesses, non-profit org~inizations <br />and the support of the general public serves as an excellent example of what can be <br />accomplished when the public and private sectors work together for a common goal; <br /> <br /> <br />
