Bo <br /> <br />Development Approvals. City acknowledges that certain <br />development approvals may be necessary or desirable in <br />connection with the development of the Project, including, without <br />limitation, zoning amendments, special uses, permits and other <br />modifications to the existing approvals for the Concord Marriott <br />and the City agrees to use its best efforts to promptly and diligently <br />consider and process such zoning and other development aplbrovals <br />required to facilitate the development. Under the Zoning <br />Ordinance, the Project is currently zoned B-3 (General <br />Commercial Zoning). To the extent pemfissible under state law, <br />the City and the County will cooperate with and assist the <br />Developer in connection with the development of the Project <br />including, but not limited to, using best efforts to facilitate the <br />timely processing of any and all plans, applications and requests <br />made by the Developer in connection with the Project. <br /> <br />Subdivision. City acknowledges that certain lot line adjustments <br />may be necessary or desirable in connection with the development <br />of the Project by Developer and tha{ the timely and expeditious <br />completion of'any such lot line adjustment may be necessary for <br />the timely development of the Project. Accordingly, City agrees to <br />use its best efforts to promptly process and diligently pursue to <br />completion subdivision application and/or lot line adjustment <br />requested by Developer including, but not limited to, the <br />simultaneous review and approval of any such subdivision plat and <br />lot line adjustment in order to permit development of the Project to <br />proceed in advance of recordation ora new subdivision map, if <br />any, subject to applicable laws. City further agrees that future <br />subdivisions and lot line adjustments requested by Developer will <br />be processed and acted upon promptly and with due diligence to <br />facilitate development of the Project. <br /> <br />Land Acquisitions. The parties acknowledge that the following series of <br />acquisitions are necessary: <br /> <br />Landex acquisition of the West Cabarrus Church property adjacent <br />to Rocky River Golf Club (approx. 46 acres); <br /> <br />° <br /> <br />West Cabarrus Church acquisition of the Landex property adjacent <br />to the pond on the southwest side of Speedway Boulevard (approx. <br />53 acres); <br /> <br />Filcnam=- S:~Planning~MOU-Marriott <br /> <br />-3- <br /> <br />Revised 09/10/98 <br /> <br /> <br />
