EXFIIIT C <br /> <br /> (A) It is fully acknowledged and agreed by the parties that Seller's sale of the <br />premises involved to Buyer is made and shall be completed solely in contemplation of <br />Buyer's condemnation thereof for the West Side High School project pursnant to <br />resolution duly adopted by Buyer, a governmental entity possessing statutory authority to <br />condemn the premises for the purposes and uses set forth in said resolution. <br /> <br /> (B) While this offer is tentatively executed on behalf of Buyer by its attorney, <br />it is expressly understood and acknowledged by Seller that this offer is open only through <br />October 31, 1998 and, in any event, conditional upon ratification thereof by the specific <br />affirmative act of the Board of County Commissioners of Cabarrus County, North <br />Carolina, in open session, and Cabarrus County Board of Education, in open session, <br />only after which it shall become binding upon Buyer, <br /> <br /> (C) Paragraph 5(e) is hereby amended to allow Seller to transfer title by <br />Limited Warranty Deed,. as approved by Buyer's attorney. The Limited Warranty Deed <br />shalt convey only the d~eded acreage acquired by Seller. Seller shall also provide a <br />Quitclaim Deed as to the area contained in a boundary surly prepared by James E. <br />Craddoek, RI.S, on July 31, 1998. <br /> <br /> <br />
