Resolution No. 1998-32 <br /> <br />NORTH C~ROLIN~ <br /> <br />CABARRUS COUNTY <br /> <br />RESOLUTION <br /> <br /> WHEREAS, Cabarrus County (the "County") owns a 1.851 acre <br /> tract of land in the area of the Cabarrus County Landfill adjacent <br /> to Mr. and Mrs. Alvin Vance Joyner and Irish Potato Road (the <br /> "County Property"); and <br /> <br /> WHEREAS, Mr. and Mrs. Alvin Vance Joyner (the "Joyners") own <br /> or claim two (2) tracts of land adjoining the Landfill totalling <br /> 1.85 acres (the "Joyner property"); and <br /> <br /> WHEREAS, th6' County and the Joyners desire to exchange the <br />County Property described in a Deed, a copy of which attached <br />hereto as Exhibit A for the Joyner Property described in a Deed, a <br />copy of which is attached hereto as Exhibit B (the "Exchange"); and <br /> <br /> WHEREAS, the County may exchange real property belonging to <br />the County for other real property by private negotiation if the <br />County receives full and fair consideration in exchange; and <br /> <br /> WHEREAS, the County has determined that the Exchange is <br />appropriate, and has advertised its intention to consider a <br />resolution authorizing the Exchange for ten (10) days; and <br /> <br /> WHEREAS, no one has objected to the Exchange in advance of the <br />regular meeting of the Board of Commissioners scheduled for 6:30 <br />p.m. on September 21, 1998. <br /> <br /> NOW, THEREFORE, upon receipt from the Joyners of the Deed for <br />the Joyner Property described in Exhibit B and their payment of the <br />advertising cost relating to the consideration of this Resolution, <br />the Cabarrus County Board of Commissioners hereby resolves to <br /> <br /> <br />
