Proposed 10/19/98 <br /> <br />II. <br /> <br />Prohibited Acts <br /> <br />A. The County prohibits the unlawful manufacture, distribution, dispensation, <br /> possession, or use of any alcoholic beverage or any narcotic drug, <br /> hallucinogenic drug, amphetamine, barbiturate, marijuana, or any other <br /> controlled substance as defined in schedules I through V of Section 202 of <br /> the United States Controlled Substances Act, at 21 U.S.C. § 812~ and as <br /> further defined in federal regulations at 21 C.F.R. §§1308.11 through <br /> 1308.15 and in North Carolina Controlled Substances Act, N.C. Gen. Stat. <br /> § 90-86 et seq. <br /> <br />B. The County prohibits the use of alcoholic beverages by any employee (1) <br /> during work hours, (2) while on any property owned or leased by Cabarrus <br /> County, (3) at any time during which the employee is acting in the course <br /> and scope of his or her employment with the County, and/or (4) at any <br /> other time that the employee's use of alcoholic beverages has a direct and <br /> adverse effect upon the performance of his or her job. Nothing in this <br /> Policy shall be construed to prohibit employees from consuming alcohol <br /> in moderation at social events, which are held off of County property. The <br /> County will consider an employee with a blood alcohol level of .04% or <br /> higher to be intoxicated and in violation of this policy. Employees testing <br /> at .02% to .039% are deemed unfit to perform their duties and will be sent <br /> home for the rest of the day without pay subject to disciplinary action. <br /> <br />2 <br /> <br /> <br />
