NORTH CAROLINA <br /> <br />CABARRUS COUNTY <br /> <br />PETITION TO CLOSE PUBLIC ROAD/EASEMENT <br /> <br /> THE UNDERSIGNED does hereby request the Board of Commissioners ~f Cabarrus <br />County (the "Board") to adopt a resolution declaring its intent to close a portion of a public <br />road/easement and, pursuant to N.C.G.S. 153A-241, to call a public hearing on said question, <br />and in support of said petition, shows unto the Board that: <br /> <br /> I. The Petitioner is the owner of real property more particularly described in Exhibit A <br />as attached and incorporated herein by reference, abutting the former mute of Quay Road for a <br />distance of approximately 400 feet in the vicinity of its intersection with Speedway/Kings <br />Grant Boulevard in No. 2 Township, Cabarrus County, North Carolina, (hereinafter the <br />"Road/Easement"). <br /> <br /> 2. As set forth in Exhibit B attached hereto and incorporated herein by reference, N.C. <br />DOT has now abandoned its maintenance of and interest in the Road/Easement. <br /> <br /> 3. The Petitioner now requests that the Road/Easement be closed to the public. <br /> <br /> 4. No individual or entity owning property in the vicinity of the Road/Easement will be <br />deprived of means of ingress and egress, and the closing of the Road/Easement is not contrary <br />to the public interest. <br /> <br /> 5. The Petitioner agrees to reimburse the County for all expenses incurred by it <br />incident to this Petition, including, but not limited to, attorneys fees and the expenses of <br />advertising of a hearing therefor. ~ <br /> <br />NOW, THEREFORE, the Petitioner prays that: <br /> <br /> 1. The Board adopt a resolution declaring its intent to close the Road/Easement and a <br />public hearing be held on the question. <br /> <br /> 2. The Board direct that a notice of the proposed closing and public heating thereon be <br />prominently posted in at least two (2) places along the Road/Easement, and that the resolution <br />be published in a newspaper of general circulation in Cabarrus County once a week for four <br />(4) consecutive weeks before the heating. <br /> <br /> 3. Subsequent to hearing on this question, the Board issue an Order closing the <br />Road/Easement, and the Order be filed in the Office of the Register of Deeds of Cabarrus <br />County. <br /> <br /> <br />
