EXHIBIT A <br /> <br /> The lots to be developed and sold within the phase of the PUD that is the subject of this <br />petition ("the petitioned area") have a sales value of approximately $44 million (and with homes <br />constructed, a sales value of $240+ million). In addition to land costs, the petitioner has <br />expended almost $2.1 million in planning and developing utility systems which now serve the <br />entire PUD, including the petitioned area. If it is denied the right to complete this development <br />by Cabarrus County, the petitioner will lose the opportunity to recover such costs and benefit <br />from such sales. <br /> <br /> In the event the petitioner is delayed by Cabarrus County in proceeding with completion <br />of this development, it will continue to pay interest on debt.and incur overhead relating to the <br />petitioned area in the amount of approximately $156,000 per month. <br /> <br /> Accordingly, the petitioner will be damaged in substantial amounts either by delay or'the <br />ultimate denial of its right to proceed as requested. <br /> <br /> <br />
