STATE OF NORTH C/¢,ROLtNA <br />COUNTY OF ROWAN <br /> <br />SALISBURY-ROWAN COMMUNITY <br />SERVICE COUNCIL, INC. <br /> <br />HEATING APPLIANCE REPAIR AND <br />REPLACEMENT PROGRAM (SUBCONTRACT) <br /> <br />CONTRACT NUMBER 98-4427-38(2) <br /> <br />PART I <br /> <br />This AGREEMENT mad'e this 1st: day of October' , 199_~8, by and between Salisbury-Rowan <br />Community Service Council, Inc., (hereinafter referred to as the "S.~bgrantee") and <br />Cabarrus Co, Dept, of Aging (hereinafter referred to .as "Subcontractor"). <br /> <br /> WHEREAS, The Low Income Home Energy Assistance Act of 1981 Title XXVI of Public Law <br />97-35, 'Stle 45 CFR, Part 96, Subpart H provides for a Heating Appliance Repair and Replacement <br />Program(HARRP) to assist in achieving a prescribed level of .energy conservation materials in the <br />homes of Iow-income persons; and <br /> <br /> WHEREAS, The Energy Division, North Carolina Department of Commerce, has' been <br />designated as the agency of the State of North Carolina responsible for administering all federal <br />funds related to the Heating Appliance Repair and Replacement Program; (hereinafter refered to <br />as "HARRP"), and <br /> <br /> WHEREAS, the Energy Division, North Carolina Department of Commerce desires the <br />assistance of local community organizations within the Slate of North Carolina in implementing the <br />Heating Appliance Repair and Replacement Program in North Carolina; and <br /> <br /> WHEREAS, the Energy Division, North Carolina Department of. Commerce has designated <br />Salisbury-Rowan Community Service Council, Inc. as the agency o¢: the State of North Carolina <br />responsible for administering the Heating Appliance Replacement and Repair Program in Rowan <br />and Cabarrus Counties (hereinafter referred to as the "Subgrantee"). <br /> <br />WHEREAS, the parties hereto desire to reduce the terms of this agreement to writing; <br /> <br /> NOW THEREFORE, in consideratkJn for the promises exchanged between both pa~ies, the <br />Subgrantee and the Subcontractor do mu. tually agree as follows: <br /> <br /> Section 1: Purpose of A~reemer;t. The purpose of this agreement is to provide for the <br />undertaking of a Heating Appliance Repair and Replacement Program (hereinafter referred to as <br />the Program), particularly for those persons with no heating system or those that 'are <br />Weatherization Assistance Program referrals in North Carolina by the Subgrantee, and to state the <br />terms, conditions, and mutual undertakings of the parties as to the manner in which the Program <br />will be undertaken and completed. <br /> <br /> <br />
