BOC certifies that water supply demands for the Facility will approximate 388,000 gallons per <br />day. Projected water demand is based on a peak flow rate of four hundred (400) gallons per minute at a <br />minimum pressure of forty (40) pounds per square inch and an average flow rate of two hundred seventy <br />(270) gallons per minute at a minimum pressure of forty (40) pounds per square inch. <br /> <br /> In accordance with the above representations, the County, the City and WSACC hereby agree, <br />provided that the Line has been constructed and is in service, to guarantee three hundred eighty-eight <br />thousand (388,000) gallons per day (incorporating a rate of four hundred (400) gallons per minute for <br />three peak flow periods of approximately 20 minutes duration and an average flow rate of two hundred <br />seventy (270) gallons per minute) "reserved" capacity for the Facility prior to allocation of the Line's <br />capacity to other users. BOC hereby agrees to pay for water service to the Facility at a minimum usage <br />rate of one hundred thirty-five thousand, eight hundred (135,800) gallons per day (forty-nine million, <br />five hundred sixty-seven thousand [49,567,000] gallons per year), or seven thousand, five hundred <br />dollars ($7,500.00) per month (ninety thousand dollars [$90,000.00] per year), whichever is less, during <br />the five-year Grant period, provided that the Line has been constructed and is in service, regardless of <br />actual usage in a lesser amount. Should actual water usage exceed the minimum usage rates enumerated <br />herein, BOC will only pay for water services actually utilized. <br /> <br /> The applicability of the guaranteed usage rate shall be measured on a fiscal year basis, <br />concurrent with the five-year Grant period. In the event that the five-year Grant period commences on a <br />date other than the first day of the fiscal year, the applicability of the guaranteed usage rate shall be <br />measured pro rata (based on days of operation) for the remainder of the first fiscal year after the Grant <br />period commences, then annually for each of the next four fiscal years, and pro rata (based on days of <br /> <br /> <br />
