termination of this Lease shall survive any such termination. <br /> <br /> 16. In~nification. Tenant will protect, indemnify <br />and save harmless Landlord from and against all liabilities, <br />obligations, claims, damages, penalties, causes of action, <br />costs and expenses, including without limitation, attorneys' <br />fees and expenses by reason of (i) use or occupancy of the <br />Demised Premises or any interest therein or receipt of any <br />rent or other sum therefrom, (ii) any accident, injury to or <br />death of persons or loss of or damage to property occurring on <br />or about the Demised Premises or any part thereof or the <br />adjoining sidewalks, curbs, streets or ways, (iii) any use, <br />nonuse or condition of the Demised Premises or any part <br />thereof or the adjoining sidewalks, curbs, streets or ways, <br />(iv) any failure on the part of the Tenant to perform or <br />comply with any of the terms of this Lease or (v) performance <br />by persons of any labor or services or the furnishing of any <br />materials or other property in respect to the Demised Premises <br />or any part thereof under any agreement or contract with <br />Tenant. In case any action, suit or proceeding is brought <br />against Landlord by reason of any such occurrence, Tenant upon <br />Landlord's request, will at Tenant's expense resist and defend <br />such action, suit or proceeding, or cause the same to be <br />resisted and defended by counsel designated by Tenant. Such <br />obligation of Tenant under this section which shall have <br />accrued at the time of any termination of this Lease shall <br />survive any such termination. <br /> <br /> 17. Construction. No construction shall be commenced <br />by Tenant on the Demised Premise~ unless the following have <br />occurred: <br /> <br />(a) The Tenant has procured at its expense all <br /> applicable building permits, licenses or other <br /> authorizations. <br /> <br />(b) <br /> <br />Tenant shall furnish to Landlord owner's protective <br />liability and property damage insurance insuring <br />the Landlord (but not exclusively) for at least One <br />Minion Dollars ($1,000,000.00) for any one <br />accident, and One Million Dollars ($1,000,000.00) <br />for any injury to any one individual, and One <br />Million Dollars ($1,000,000.00) for damage to <br />property. <br /> <br />(c) <br /> <br />Tenant shall have delivered to Landlord <br />satisfactory proof that worker's compensation <br />insurance has been procured to cover all persons <br />employed in connection with the construction. <br /> <br />12 <br /> <br /> <br />
