These types of land uses are currently either permitted, or per,,dtted based on <br />standards, in the (OF/LC) zoning districL To control the extent of this potential <br />action, staff recommends that a density limitation be established in the (OF/LC) <br />zone which would limit multi-family ~sidential, duplex and townhouse <br />development to six (6) dwelling units per acre. <br /> <br />The density limitation provides future opportunities for mixed-use projects with an <br />appropriate density to coexist in appropriate areas which support limited <br />commercial zoning. Since well planned, mixed use projects are deemed to be <br />desirable and an efficient use of land, a density bonus of two units per acre has <br />been identified as an incentive to encourage their developmenL Mixed use projects, <br />which are generally defined as a successful physical and functional integration of <br />commercial and residential land uses in a multi level complex. These types of <br />projects are eligible to receive the density bonus provided that the performance <br />based standards for this type of development are satisfied. <br /> <br />Existing Uses: Existing multi-family residential, family care and group care <br />facilities should be allowed to remain in the General Commercial Zoning District <br />with the understanding that these types of land uses would be considered (once this <br />amendment is adopted) to be non conforming and any expansion of these uses <br />would be subject to the provisions of Chapter 14 of the Cabarrus County Zoning <br />Ordinance. <br /> <br />Vesting: Vesting to claim process under current development regulations is hereby <br />established to be thirty (30) days from the effective date of enactment of this <br />Ordinance Amendment. The landowner who desires to a vesting of foi-mer district's <br />use but does not wish to secure the necessary zoning permit or is unable to do so tn <br />the thirty (30) day timeframe, shall submit a site plan within thirty (30) days. All <br />requests shall be subject to the general procedures outlined in sections 1-7, 1-8 and <br />1-9 of the Zoning Ordinance with the exception of complying to the revised <br />timeframe, as specified herein. <br /> <br />Proposed Changes: <br /> <br />L Revise Chapter 3, Section 3-7, COMMERCIAL DISTRICTS, (2) General <br />Commercial; Uses in the General Commercial Zone to eliminate the <br />following: <br /> <br />Pem-,itted uses <br /> <br />Family care home <br />Group care facility <br /> <br />Permitted Based on Standards (PBS) <br /> <br />Duplex <br />Multi family residential <br />Townhouses <br /> <br /> <br />
