229 <br /> <br />DRAFT <br /> <br /> Chair Casper opened the public hearing for Petition 96-06(T) at 7:20 P.M. <br />and asked if anyone were present who wished to address the Board regarding the <br />proposed zoning text amendment. <br /> <br /> Mr. Jim Scarbrough, Attorney, stated his clients (Mr. C. F. Little, Mr. <br />Fletchel Little and Mr. Vernon Little) wished to preserve their right to build <br />multi-family dwellings on property located on Morehead Road and Highway 29 near <br />the Charlotte Motor Speedway. In order to do so, he asked that his clients be <br />allowed to downzone their property from commercial to high density residential. <br /> <br /> Mr. Hartsell advised that Mr. Scarbrough's clients or any other property <br />owner may file an application requesting such a change in zoning. <br /> <br /> Mr. Larry Williams, resident of Albemarle Road, questioned how the proposed <br />amendment would affect the taxes on his property that is zoned Limited <br />Commercial. <br /> <br /> Mr. Clifton explained the amendment under consideration would be a <br />provision in the zoning regulations that would remove or limit the number of <br />multi-family dwellings permitted on a piece of property. <br /> <br /> Mr. C. F. Little asked if the Board would favorably consider an application <br />to rezone his family's property to high density residential. <br /> <br /> Chair Casper advised that the Board would give due deliberation to any <br />rezoning requests that it receives. <br /> <br /> Mr. Ted Little questioned the possibility of his son being allowed to build <br />a house on family property near the Charlotte Motor Speedway. It was determined <br />that Mr. Little's property is located within the City of Concord and therefore <br />not regulated by the County's Zoning Ordinance. <br /> <br /> Mr. Oliver J. Deese of 9420 Davidson Highway questioned the current zoning <br />of his property. <br /> <br />Mr. Marshall advised that Mr. Deese's property is Limited Commercial. <br /> <br /> Mr. Pleas Christenbury of 673 Grandview Drive questioned the relationship <br />between the zoning of property, the use of the property and its value. He <br />complained that he could not build a single family house on General Commercial <br />property near the Charlotte Motor Speedway and that property values are higher <br />in Cabarrus County than Mecklenburg County for adjoining property. <br /> <br /> Mr. Marshall briefly discussed the relationship between land uses and <br />zoning. Stating that he is not appraiser, Mr. Marshall commented that appraisals <br />are based primarily on like sales in an area. It was noted during discussion <br />that County appraisers would be better qualified to give a detailed analysis <br />regarding the valuation of property. <br /> <br /> Mr. Dale Tucker of 15221 Albemarle Road, Charlotte, questioned the zoning <br />of his property which has no road frontage in Cabarrus County but borders <br />frontage property in Mecklenburg County. <br /> <br /> Mr. Marshall advised that he would have to look specifically at a map of <br />Mr. Tucker's property to determine its zoning. Generally, he stated that <br />property to the south of Highway 24-27 at the county line is Limited Commercial <br />and that the frontage property on the north side of Highway 24-27 is General <br />Commercial. <br /> <br /> Mr. David Yawn of 2131 Odell School Road, Concord, expressed concern that <br />he is faced with having commercial development two lots from his home or having <br />multi-family residential facing his back yard. He questioned the provisions for <br />buffer zones for residential communities. <br /> <br /> Mr. Marshall briefly reviewed the requirements for screening and buffering <br />between different zones as well as between different uses. <br /> <br /> Mr. Robert Swanson of 3807 Highway 24-27, Midland, requested clarification <br />regarding the zoning of his property and asked for examples of permitted uses in <br />both General Commercial and Limited Commercial Districts. <br /> <br /> <br />
